Man Passes Gas, Charged with Battery on Officer

CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.

Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.

Then, he failed sobriety tests and was arrested.

When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong.

Cruz is now charged with battery on a police officer, as well as DUI and obstruction.

Sometimes when people eat beef and bean burritos, the aroma is stronger than at other times.

I wonder what this dude ate?

Why is it battery on an officer? If the gas is ready to come out, well............

Yeah, and given the circumstances, I’m not sure how they could charge the guy with obstruction.

Defense: Your honor, this case stinks. He didn’t laugh, spit, fight the officer...he did what mother nature sometimes demands. Mother Nature belongs in jail not this man obeying the rules of nature.

That would work. Or send him to Al Gore? Maybe Boone Pickens can use him as a supplier in his new fangled company.

Farting is now an assault on a cop. Nice.

Cops are getting pretty wimpy these days. I hope the Judge is a military veteran. I would expect that such a Judge would toss the charge and chew out the cop.

Something about kitchen heat and the Queen’s shilling I would expect.
