First California Same-Sex Wedding June 16 By: ANDY HUMM 06/12/2008 Veteran lesbian activists Del Martin, 87, and Phyllis Lyon, 83, whose 2004 wedding in San Francisco was invalidated by the California Supreme Court, will be the first same-sex couple to legally marry there on Monday, June 16 at 5 p.m. when the high court's May ruling finding a constitutional right to marry for same-sex couples takes effect. It is the only one that Mayor Gavin Newsom will allow that day before county clerks across the state must begin issuing licenses to same-sex couples the next morning.

The clerk in rural Kern County is resisting the change, suspending marriage solemnizations - but not licenses - for straight and gay couples.

The Washington Post raised a novel argument that if a constitutional amendment passes in November limiting marriage to man-woman couples, the state may not be able to marry gay or straight couples under the California Constitution's equal protection clause.

Another legal challenge to the amendment under consideration relates to wording in the signature petitions that got it on the ballot claiming there were no fiscal consequences to passage because it would not change state law. Under the law now, however, the amendment would necessitate a change - the costly replacement of the new forms in place starting next week for marriage license applications.

There’s already a precedent for a Constitution making something illegal that used to be legal. Of course we pretty much have a precedent for taking awaybthe people’ sright to amend their constitution here in MA.

There’s already a precedent for a Constitution making something illegal that used to be legal. Of course we pretty much have a precedent for taking awaybthe people’ sright to amend their constitution here in MA.

Was flipping through the channels on the DISH yesterday, and made a very rare foray into the highest ones, where the Hippie Channel is (9415 - “Free Speech for Me But Not for Thee TV”) and there was Mr. Humm. What a perfectly appropriate name.

They showed a piece of tape with those two old women, and one looked pretty much like that North Korean dwarf because of her clothes.

Yes, they do. I know several gay couples in their 60s and 70s. A lot of gay men do get HIV/AIDS, but a lot don't. The ones that settle down and live quiet lives are much less likely to get infected.

OK, so gay marriage starts in California today. I think most people here are going with the assumption that it will be overturned in November and then wondering what happens to all those who were married between now and then. But I haven’t heard anyone address the question of what happens if the voters don’t amend the state constitution and actually ratify gay marriage. There’s always a possibility it could happen. What then? A federal marriage amendment is a non-starter as long as the Dems control Congress, which they still will after November. Is all lost if the votes don’t go our way on the amendment in November or is there a backup plan? Anyone?

Unfortunately, we were involved in trying to get the Federal Marriage Amendment passed around four years ago. Problem was, nobody seemed to care or see the grave importance of the issue at the time and too many in Congress were shrugging it off saying “It’s a state issue”. Now, here we find ourselves facing this tyranny and depravity. I pray to God we get this amendment passed because this will inevitably creep into other states. The saddest part is that this would have all been avoided if that Federal Amendment had been passed.

As far as the future is concerned, the courts decision has set a dangerous precedent using judicial activism and overturns the direct will of the people. What’s next?

Our only current option is to spread the word about the California Marriage Protection Act (Amendment) on the ballot this November and VOTE!!!

They tried this asinine argument in Texas several years ago, and I truly believe it had the opposite effect. Marriage won by over 76%.

Sounds like, according to you, the courts aren’t taking anything the people won’t let them have. If Californians vote at the polls to permit gay marriage, I don’t see much recourse.
