Is Obama Leagally Qualified to be President?

I really haven't the slightest knowledge about this issue, but I did find an interesting analysis of his status, as a "Naturalized Citizen"...

Hmmm - "release birth certificate" - that's usually a very easy thing to do - just go to the county courthouse (or state agency handling such matters) and ask for a copy of a particular birth certificate.

People do that all the time for all sorts of reasons.

I doubt I could do anything to prohibit the "release" of my own birth certificate.

Yes and don’t forget there have been some in the past....

The blogs are working overtime spreading the rumor. One prints something and the others copy and post to theirs with a comment or two. What a way to spread truth or untruths.

And I'm sure that if his mother were applying for a service or position that required proof of citizenship, such as a passport, she would be able to provide here birth certificate to prove her citizenship.

So why is Obama unwilling to provide his for the position of President?

I’ve read that that’s not the policy in Hawaii, where birth certificates are not available to the general public.

Hawaii was granted Statehood in ‘59. Obama CLAIMS to be born in ‘61, only two years different. If Obama’s claims are true, then yes, he is a citizen.

Statehood has nothing to do with it.

Hawaii has been incorporated US territory since 1898.

If he was born prior to the granting of statehood, then he was born abroad and is a naturalized citizen.

Incorporated US territories are not foreign countries, and are not considered "abroad."

Hawaii was the last incorporated territory with a population, BTW.

I was born in Canada and cannot become President. You guys are really missing out.

The only problem with that view is the law (Hawaii Statehood admissions act of 1959) section 19 specifically states that the adoption of the act, does NOT confer nationality.

I heard he was born in AFRICA to a MUSLIM father and went to Muslim schools. You think this is the kind of person we should allow to be President? It may not even be legal. We need to keep pressing this issue between now and the election.

Before you get too crazy about Obama, who was born in Hawaii (a State) to a US Citizen you should look at McCain.

Never go down a rabbit hole unless you plan on following where it goes.

You heard incorrectly.

I suspect that this a fairly common occurrence for you.

You think this is the kind of person we should allow to be President?

The question of whether Obama should be President is a separate question from whether he can be President.

We need to keep pressing this issue between now and the election.

No we don't.

We need to address real issues and not made-up ones.

This is probably nothing, but I find it interesting they don't want to release it. It also reminded me of the passport "scandal" a few months ago..

Three State Department contractors had taken unauthorized looks at the electronic files of each of the candidates, although each had clearance to use the database, Undersecretary for Management Patrick F. Kennedy said Thursday. Obama's file was accessed three times: Jan. 9, Feb. 12, and March 14. It was disclosed later that the files of Clinton and McCain were also reviewed by the contractors.

I'm wondering if there could be a connection. Anyone have thoughts on this?

Let's look at what the Act actually says:

"Nothing contained in this Act shall operate to confer United States nationality, nor to terminate nationality heretofore lawfully acquired, or restore nationality heretofore lost under any law of the United States or under any treaty to which the United States is or was a party."

It specifically refers to nationality gained or lost under a US law or treaty before ("heretofore") the passage of the Act.

In other words, everyone residing in Hawaii the day the act was passed experienced no change in their nationality.

Those who were born in the incorporated US territory of Hawaii retained their US nationality just as before.

Resident aliens who did not have US nationality before hawaii became a state did not magically become US nationals, but remained resident aliens of the state of hawaii just as they were resident aliens of the terriotory of Hawaii.

The change from territoriality to statehood had no effect on the national status of any person living in Hawaii.
