Well phrased Win-mag; small win vs total defeat. Like you, I’ll take it. And as usual, the anti-crowd won’t give it up with more lawsuits. One city at a time.
Hmmm... Though, I’m a bit more optimistic. I see this as a fairly significant win.
Scalia’s opinion tightly nailed down a few key variables. The individual right of course, but he also micely marries the “keep” (own) concept and the “bear” (carry) concept in defining the essence of the right to self-preservation. While the Heller suit was specifically about his desire to have a gun at home, the opinion went further than the findings to the right to defend yourself not merely at home but in public.
One thing that will work in our favor (I think) is that we now have a fine experiment underway in DC. After 32 years of the strictest gun control and the highest crime rates, now guns will presumably be proliferating into the hands of honest citizens. Over the next few years we have a beautiful experiment to prove that more guns = less crime. I’m confident that this is precisely what the data will show.
And, as usual, a lot of those suits against us will be financed by our own tax money.
And the gun-grabbers were sweating it out, too. There was the vey remote chance that the court would strike down ALL gun laws, including NFA and GCA. I wouldn't have minded.
My own view of "militia weapon" means that if it takes more than a crew of three to carry it, it needs a $5 "any other weapon" stamp.
