Missing (Pregnant) Marine Dead, Authorities Say
KWTX ^ | 1/11/2008 | n/a

January 11, 2008)--Authorities in North Carolina said late Friday morning pregnant Marine Lance Cpl. Maria Lauterbach is dead.

They said she’s buried in a shallow grave, for which investigators are now searching.

They identified the suspect in the case as a Marine officer whom she accused of sexually assaulting her.

Police earlier were planning to interview a man who lived with her and said he would answer questions that "will shed a lot of light on the case."

Authorities said again Friday Marine Sgt. Daniel Durham isn't a suspect, but police believe he's the last person to speak with the Marine.

She disappeared Dec. 14 ahead of her expected testimony in a military investigation into her claim a senior officer had sexually assaulted her.

Court documents show the investigation went sour amid inconsistencies in the woman's story and allegations that she's bipolar and a compulsive liar.

Search warrants show she was facing a possible discharge from the service.

Lauterbach was eight months pregnant when she disappeared.

I thought that I read yesterday that Laurean claimed that he didn’t have ANY kind of sexual contact with Maria. I’ll have to go check, but I thought that’s what I heard/read.

Even though the military expects Marines to be faithful to their spouses, there is no formal discipline that I have ever heard of in my 13 years of being in the military world as a result of adultery.

A DNA test on the baby will determine once and for all if he did have sex with Maria (or at least, if the sex he had produced a baby).

Naughty Soldiers: What Does the Military Consider ‘Immoral Behavior’?
Slate.com
by Christopher Beam

Gen. Peter Pace, chairman of the Joint Chiefs of Staff, compared homosexuality to adultery in an interview with the Chicago Tribune on Monday. “We prosecute that kind of immoral behavior,” he said. What other kinds of immoral behavior does the military prosecute?

You name it. Bigamy, sodomy (with either gender), wrongful cohabitation, gambling, dueling, indecent exposure, indecent language, indecent acts, pandering, prostitution—all of these are considered crimes under the Uniform Code of Military Justice. If you’re an officer, you’re also subject to “What other kinds of immoral behavior does the military prosecute?”

a general prohibition on “conduct unbecoming an officer and a gentleman.”
This rule, as interpreted in the military’s 900-page courts-martial manual, can be used to prosecute things like cheating on tests, stealing, public drunkenness, failing to support your family, and reading someone else’s mail. To top it off, the military can also prosecute anyone for anything that damages the “good order and discipline in the armed forces” or makes them look bad.

Wellll,
things that look squicky are—
Her saying they had two encounters.
Him telling folks his wife was having a baby.
Her being dead in his back yard.

If they didn’t have sex and she wasn’t pregnant with his child....

WTF is she doing dead with her skull cracked in his firepit?

I recall Cohen case out sort of in defense of adultery in the military, perhaps prodded by Clinton.

According to The New York Times, July 21, 1998: Adultery is a crime under military law and enlisted personnel convicted of adultery could be discharged for bad conduct. Defense Secretary William Cohen, however, wanted to reduce prosecutions for adultery. He wanted - I do not know if he achieved it - for commanders to file charges of adultery only if they felt it disrupted morale or functioning of the unit - it Cesar's case it sure did. Cohen also wanted that enlisted personnel discharged for adultery no longer automatically lose all benefits and pensions.

You are awesome!

Isn’t that strange - how some of us either didn’t read that, overlooked it, forgot it or thought he admitted to a consensual sexual encounter(s).

It may have been my fault speculating that if there had been a positive DNA he would have claimed consensual sex.

See why we need two threads? one for facts and one for pondering.
