Avril Lavigne is being sued by two songwriters who claim that her hit "Girlfriend" sounds like a track their American power pop band recorded in the '70s.
Tommy Dunbar, the founder of the Rubinoos, filed the suit in California's Northern Federal District Court in San Francisco on July 2. The suit alleges that "Girlfriend" bears striking similarities to the Rubinoos' song "I Wanna Be Your Boyfriend," co-written by Dunbar and former Rubinoos' road manager James Gangwer, and released by Beserkley Records in 1978.

That song hit the charts six years before Lavigne was born. Maybe she heard it somewhere. I sure didn’t.

(A) her first album was written for her. The hype may now be that she writes her own songs but she’s an industry pop star.
(B) this band is experiencing some reissuing in their career. 70s rock and power pop has come back.

The songs compared.
WARNING! The latest song has dirty words in it... the 1979 song doesn't. They sound nothing alike to me... and I've been a professional musician.

The Greg Kihn Band is probably the most famous Beserkley Records artist (because of some early MTV videos) but Jonathan Richman and The Modern Lovers probably had the bigger hit (at least in Europe) with Road Runner and later Egyptian Reggae.

You can’t hear the similarity?? Maybe being a pro makes it LESS easy. I don’t know.

You cant hear the similarity?? Maybe being a pro makes it LESS easy. I dont know. I hear some similar chord progressions... but they can be found in many pieces. I'll listen again...
