Paris Hilton Sent Back to Jail

A "screaming" Paris Hilton has been dragged off to serve her full 45 days in jail. Reportedly screamed and called to her mother as she was taken away. More.

She wasn't charged with hitting or killing someone so this example is moot.

No. It's not. She thought her DUI was a joke and so was being caught twice driving on a suspended. Do you think she was going to stop driving while under the influence? She didn't stop driving when revoked. She'd keep driving while drinking and drugging and the next time she drives in the wrong lane it may cost someone else very dearly. The time to teach her a lesson is BEFORE she kills someone.

Why are so many of the women on this forum so delighted in her fall from whatever grace she had?

All that is irrelevant.

She has been singled out for disproportionate sentencing by a judge who has his own press conferences over this matter and not one person can refute my claim that every legal talking head I’ve seen says no one gets sentenced like she did. Not one.

Please go mine the internet and come up with something and I will stand corrected. I have seen at least a dozen folks on Greta from lawyers to DAs to mark Fuhrman claim she got hosed at sentencing by an angry judge who is now squabbling with Baca.

It’s abusive to me and could happen to anyone.

The fact that she was warned but not ticketed does not count as a violation legally. It just doesn’t.

She has had only one revocation.

I also have never in my life seen a judge reincarcerate someone a sherrif or bureau of prisons let out early...never ever.

Geez, I confess. Driving on a suspende license should not be a jail time offense to me....community service maybe or a few furlough weekends maybe but 45 days is draconian.

I like Fox, and their experts are a cut above the ones on the other networks. And I have to admit, I didn’t watch any TV today. But as it pertains to Paris Hilton’s sentence, I wouldn’t be surprised if even Fox’s “experts” couldn’t tell us what the average sentence has been over the past year for a probation violation in an L.A. court.

In many of the comments in this thread, some referring to the news experts, lots of people focus on Paris’ violation of driving with a suspended license. But that’s only part of the prosecutor’s motion to revoke Paris Hilton’s probation. (There is a copy of the motion on the “findlaw” site. It looks genuine). The motion lists several incidents in which Paris violated the terms of her probation. The prosecutors asked for a 45 day sentence, which I imagine they calculated from some form of sentencing guidelines. Then the judge agreed. This doesn’t seem excessive to me for a multiple-count probation violation.

I wish we had a computer link to their sentencing stats.

Second offense for DUI here in TN within 2 years of first offense only carries 48 hours.

Have they changed the law in the last year? I was under the impression that it's 48 hours for a first offense and a minimum 45 days for the second.

On of my employees just got a DUI...no jail time.

I believe severity of sentence on second offense is dependent on nearness to first(?)

I will look it up.

you’re right.....since 2004 all subsequent offenses within 10 years require varying jailtime and the 4th offense becomes class E felony

but...jail time can be waived even thought it is min-man at judges discretion or can be served at community custody as night or weekend halfway house.

A good foundation of edcuation can set life in motion on the right track..

....or you can get worthless degrees like I did at our alma mater and just jump out there.

we have a friend here who is 9th generation MD ...obstetrician....all the way back to Virginia and colinial times.

a good education often continues thru families...a good thing

Not according to this report, this article states " a long-standing fight between the Sheriff's Department and the courts over time actually served." :

Because of overcrowding in Los Angeles County jails, release criteria now call for female offenders to be freed after serving 10% of their projected sentence. So for an inmate who, like Hilton, was sentenced to 45 days, serving no more than four days would be the norm. (There are no statistics on how much time probation violators serve in jail.) But in Hilton's case, Sauer issued specific instructions for a longer sentence: no private jail, no electronic monitoring, no early release. Her release despite the judge's objections highlights a long-standing fight between the Sheriff's Department and the courts over time actually served. Regardless of what the judge said, time actually served by county inmates is still determined by the sheriff, who is allowed to release them early under federal orders to reduce crowded conditions. Since mid-2002, when Baca shut down thousands of jail beds in the midst of a county budget crisis, more than 200,000 inmates have gone home after serving only fractions of their sentences. In addition, Baca has the ability to give "compassionate releases" to misdemeanor offenders.

I agree with all your comments. I don’t have a problem with Paris serving her time in jail OR under house arrest, but I feel bad for her today because they sent her home and then yanked her butt back into custody and that was not her fault. They really screwed her; I suppose it was her own attorneys who did so. Didn’t they also know what would happen when the DA and judge got wind of her skipping out in the middle of the night? They set their little princess up, and I felt for her today.

Also, how much had she even had to drink that first DUI? What does she weigh, 100 lbs? Maybe a glass of wine could have given her a 0.08. Of course the little idiot should have had a driver that whole time, but the truth is, she was not driving smashed. I am no fan of hers but I was a little princess once and I can imagine what this must be like for her. I’d like to get some responsibility into her little pointy head, but the punishment really doesn’t fit the crime.

Doctor of Pharmacy...PharmD.
It’s a professional school, like Med school, or Law school.
Four years of post grad work.

I got Torie on that one time.
He didn’t know anything about it, and kept calling my daughter a “pill pusher.” ;o)
But, he didn’t know that this is a new field.

Excellent....they sure get lots of my middle aged business and I am quite fond of a few of them

at the risk of being sexist....I think women are better at this field than men.

they listen good and are more empathetic.

People do not get arrested for some supposed future crimes that they have not committed and YET to commit. Sorry but Minority Report is a fictional movie not real life. Unless you know of some law that the rest of us don't.
