She has been singled out for disproportionate sentencing by a judge who has his own press conferences over this matter and not one person can refute my claim that every legal talking head I’ve seen says no one gets sentenced like she did. Not one.
Please go mine the internet and come up with something and I will stand corrected. I have seen at least a dozen folks on Greta from lawyers to DAs to mark Fuhrman claim she got hosed at sentencing by an angry judge who is now squabbling with Baca.

The fact that she was warned but not ticketed does not count as a violation legally. It just doesn’t.
She has had only one revocation.
I also have never in my life seen a judge reincarcerate someone a sherrif or bureau of prisons let out early...never ever.
Geez, I confess. Driving on a suspende license should not be a jail time offense to me....community service maybe or a few furlough weekends maybe but 45 days is draconian.

She showed that she has no respect for the law and will not obey it. The judge gave her boundaries. She ignored them. Now she has consequences.

From the original judges order: When she was sentenced May 4, Superior Court Judge Michael T. Sauer ruled that she would not be allowed any work release, furloughs or use of an alternative jail or electronic monitoring in lieu of jail.
Baca is in contempt of court because of the outlines in the sentencing.
It certainly indicates her intent and level of respect for the law.

It was revoked for reckless driving in connection with her DUI. And she drove TWICE afterwards. The rules don't apply to blonds when lust is involved?

For purposes of a Violation of Probation hearing the warning can and does come into play.
The fact she was driving at that time can be considered along with the second ticket.
This is similar to cases where a defendant on probation can be found innocent of a subsequent unrelated solicitation charge where the alleged prostitute is an undercover officer but then be convicted of violating probation due to the fact the probationary should not have been talking to prostitutes and the burden of proof to violate probation is waaaaaaaaaaaaaaaaaaaaay lower. Shockes the concience test.
In reality, if the judge had become aware of JUST the warning he could still have held a violation of probation hearing on that alone.
Probation means PROBATION.
Of course I am just speaking accademically since she was also chared with a substantive driving on suspended which triggered the core VOP.
