Maybe this will help... (this is probably how it all went down)

Pinder (a very good Bahamian lawyer) said (word for word the other day)...

The point is the lawyers (Larry's) have to push this, they have to argue that a DNA test is indispensable to the resolution to the case on the merits. Once they press that and push him up in the corner and if he doesn't take the test (have the test done on the baby) then he loses the case because the DNA test would be indispensable. So it depends on the arguments of the lawyers more than upon the judge ordering that someone take a test because a person cannot be forced to do anything.

Then the CTV reporter says.... ok then if he does not take the test (provide the baby for the test) then the presumption is that he is not the father. (fear nothing and have the test done if you are the father - that is how they do things over there - their morals)

Pinder said yes but was cut off by the camera before he could say more.

in·dis·pen·sa·ble
1. absolutely necessary, essential, or requisite: an indispensable member of the staff.
2. incapable of being disregarded or neglected: an indispensable obligation.

merits
Law A party's strict legal rights, excluding jurisdictional, personal, or technical aspects.
The factual content of a matter, apart from emotional, contextual, or formal considerations

Jean C explained this the other day. Said they "request" it, but basically if you don't do what the judge "requests" you can be held for contempt of court. Guess in the English Courts they just have a more polite way of saying you are ordered to do something.

~LOL~ no, just that all the drugs HKS and KE were feeding her also have a side-effect of weight loss.

She was the only one who knew anything accurate about this case. I just remembered the other thing Wecht said that ticked me off...

.he said he is convinced ANS didn't have methadone in her system and he is angry that Perper is going beyond his job as ME in over-investigating this death.

Everything Wecht had to say on H&C makes me believe he has talked and may still be talking with HKS

He wants the world to think she died from natural causes. I think because he has a dog in this hunt if someone looks closer at Daniels death and his autopsy analysis.

Does that help?

they have a odd way of doing things over there - there is also no pleading the 5th over there. If you don't talk they throw your @ss in jail until you do talk.

It was also said that if 2 Bahamian men were fighting for custody over a Bahamian child just as these 2 are. They both would be directed to take the DNA test and submit the child for DNA. If one father refused to submit his DNA he would automatically loose the case and the child would go to the other father without any DNA tests being done.
Why they are not forcing Stern's DNA is probably because it was easier for the judge to get Stern to submit the baby for DNA instead of getting both Stern's and the baby's DNA. Stern does not want his DNA taken and he thinks he can hold on to that baby if Birkhead does not match up. Basically they forced Stern up against a wall. But Stern won to some degree but Larry will now learn if he is the baby's father or not. If Birkhead is not that father... then it will be up to Virgie to push Stern to do a DNA test.

Look at post #466 at this link - I don't want to copy it or paraphrase it - it may be a story on tmz, but I don't want to switch pages because it has been overloaded.

HKS and ANS hired Wecht to do a 2nd autopsy on Daniel. Wonder why HKS didn't ask him to do a 2nd one on ANS?

I was interested in Wecht tonight, too.

On the split screen, when everybody else was laughing at Howard, he was NOT. He looked uncomfortable.

He's in the bag.

And he's going to end up looking worse than he already does.

It's like the old joke, we've already decided what he IS, we're just haggling over the price.

You just got me to thinking. Wonder why none of her patients have come forward to say how wonderful she is?

I have it in for her from the Duke LAX case.

Now to the subject at hand. Wecht appears to be in the tank for (or with) HKS and I completely agree that he's worried that his autopsy on Daniel might get a review.

Just a guess, but they're proabably afraid that their prescriptions will be traced. In CA, scripts for those drugs are written in triplicates and one copy is sent to the state and kept on file forever.

He's gone to bed, so I might be wrong about the state keeping one copy. It could be the DEA, since the doctor's DEA number has to appear on every script he writes.

That's right and they don't look kindly on doctors who over prescribe and are not adverse to marching them out of an office in the middle of day in handcuffs.

but..... if it left no trace, how does he know?

Evidence left behind. The vials maybe. Maybe it has something to do with the alcohol swab site. Or maybe it is something that isn't expected to leave a trace, but did.

I think he was paid off to deliver a diagnosis that would bury the real cause of Daniel's death.. Wish someone would ask him about the bruises on Daniel.

The patient recipients of the scripts are also drug abusers, so I'm guessing they don't want to come forward for that reason alone.
