Cab driver in lacrosse case acquitted (DukeLax cabbie escapes Nifongery)

The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.

Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.

After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hecht’s department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafa’s cab, which sped away.

The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.

Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.

Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

the duo predicted a snowball effect of other Duke student groups coming to Students for an Ethical Durham to help out in the voter registration drive, which seeks to register 2000 Duke students in time for the November election.

I can't wait to see how Broadbutt spins this phenomena to the pots bangers when they start whining that the "out of towners" are diluting their influence...

I guess the message didn't sink in.

(For that matter, where is Darryl Hunt?)

There should be a special "James Coleman" award after this,
given for the law professor who most lived up to his moral and ethical responsibilities.

Once more the students prove to be wiser than the administration. I think the hippies of the sixties are running the place but the students are rebelling. How ironic is that?

And the hippies are proving to be the least liberal of them all!

My son keeps asking what groups I liked and then tracks down their music. Boy was he shocked when I pulled up in front of his soccer team blaring some Jimi Hendrix. I told his friends, it isn't mine, it's his. LOL

My son was rocking out to this new song "American Woman" by Lenny Kravitz so needless to say he was shocked when I pulled out the original LP by The Guess Who and put that on. He was so busted.

The test results would have revealed any drugs in her system that have a long enough half-life to get into her hair. He may have thought a date-rape drug could be revealed. He may have thought nothing would be revealed and, even though he made the claim to the media about a date-rape drug being used, he may already have known there wasn't one used and he was hoping the test results would be negative to all drugs so he could shoot down the defense claim that Mangum was out of it when she arrived.

Yep - I use it elsewhere as well. It's a litmus test for people under a certain age. When I get halitosis jokes from people who don't get the reference I can generally be sure they are too young to bother with.

The momentum from the student organizers has to put enormous pressure on Nifong and his handlers. A riled up student body that can organize 2000-plus votes has the potential to shake up a lot of vested interests in Durham.

As to the ongoing miserable performance of Brodhead, Duke's Alumnae presumably are continuing to put pressure on the administration and Trustees. The Law Faculty are a lost cause until one of their own is caught in a compromising situation and is falsely accused.
