Okay, so this was a sham to keep anybody else from being successful in ousting him. What's in it for Cheek?

That is what I have been thinking for a few weeks now. He had all the signatures he needed, but he wouldn't commit. Cheek played everyone for a sucker.

So it would have been easy for Cheek, a well known Dem, to suck up the finite number of protest signatures against Nifong that were in play.

Right, why would a angry democrat sign a form to get a republican on the ballot when they could sign one to get a democrat on instead. They might be pissed off, but they still would prefer a rat win.

Yep at the time Cheek jump into the signature competition I wondered if his goal was to split the anger and prevent either Cheek or Monks from getting on the ballot. And if they both got on the ballot, the could split the anti-Nifong vote assuring him of a win.

But Ken H showed how this can backfire. If everyone will just vote for Cheek anyway, then Nifong is gone.

I read on the courtv Duke board that Cheek stated : If he wins , he would ask the gov to appoint the DA. So he isn't helping anyone.

And as I said before if Nifong wins the election everyone is in more danger round the country.

Had Eagle County CO DA Mark Hurlbert loss his reelection bid after wasting so much county money on what was probably not a winnable case and likely not a rape at all, Nifong might not have pulled this stunt. Now I think there was no case against Kobe Bryant which others disagree with, but most I think would agree there was 10 times the case there as in this case. It is dangerous for a DA to get away with what Nifong has.

Basically, Cheek's name on the ballot is like an empty slot.
You can vote for an empty slot instead of Nifong and then hope the governor appoints someone better than Nifong, I guess.

The courtv poster Memory Alpha posted the newspaper link , which states If Cheek WINS , Cheek will DECLINE , & Ask Gov. Easley to appoint the D.A.

That is as good a result as any for me. I couldn't care less who is the Durham Co. DA AS LONG AS IT IS NOT NIFONG. It is bad for the national criminal justice system for Nifong to get away with what he did. I just want him punished.

Do politicians ever like to admit they are wrong? Easley appointed him and will probably feel the need to reappoint him so he doesn't look like he made a mistake the first time around.

You are right that there was a much stronger case against Kobe. There was DNA that sex did occur (no proof so far in Duke case of any sex occurring); Kobe apologized - if not guilty, why apologize?; the deadly silence from his wife and that ring; and Kobe settled for what was rumored to be a hefty sum. Maybe this gave people ideas that, guilty or not, the families of the lacrosse players will also settle.

Would that be possible if Nifong lost in November? To lose but be "re" appointed. Sounds like that might be political suicide for Easley. He has to have his eye on a senate seat or something. I doubt he's going to leave politics after his term. Seems like there could be a backlash depending on how this plays out. The FA could very well get on the stand crack under the pressure & ruin them all. Have to admit I'd love it.

I don't think politicians ever want to admit they've made a mistake. But Nifong is a threat to Easleys political future if the good governor continues to stand by him.

Criminal case can not be settled.
If anybody tries to pay off Precious, they could be convicted for tampering with the witness.
Kobe settled instead of a civil trial.

If Nifong loses in an election, to a candidate that didn't even run, I would hope Nifong won't be appointed.
Can I guarantee it? No. But at least if Nifong wins in an election, then for sure Durham is getting Nifong as a DA.
There is no doubt there.
