Call adds mystery to lacrosse case (DukeLax)

Phone use spans time of team party

In the middle of a Duke lacrosse party where a dancer said she was gang-raped for 30 minutes, a call was placed from her cell phone to a Durham escort service.

The 12:26 a.m. call to the service, Centerfold, lasted one minute, according to a copy of her cell phone bill reviewed by The News & Observer. It is unclear whether the call was a request for another job, a cry for help or something else, or even whether the accuser made the call herself.

But the accuser's phone records add some details to the chronology of the March 13 party, a drunken spring break bash that spawned a national controversy.

Neither prosecutors nor defense lawyers would discuss the phone records Tuesday. Neither the accuser nor a second dancer at the party could be reached, nor could representatives of Centerfold. Police Chief Steve Chalmers was out of town; his spokeswoman said he would not discuss the case.

Three players have been charged with first-degree rape, sexual offense and kidnapping: Reade Seligmann, 20, of Essex Fells, N.J.; Collin Finnerty, 19, of Garden City, N.Y.; and Dave Evans, 23, of Bethesda, Md. Lawyers for the players have proclaimed their clients' innocence and said no rape or sex occurred at the house at 610 N. Buchanan Blvd.

District Attorney Mike Nifong, whose handling of the case has undergone national scrutiny, has been adamant that the woman was raped at the party. Nifong has not given a precise timeline of when he thinks an assault occurred.

Remember the DNA? Cheshire said "known to the police?" I have always thought that strange wording.

Are we assuming it is the boyfriend or has that been documented?

Of all of the people feeling pressure to resign, it is Chalmers?

It's good to know that the County of Durham has so much money available for trying three separate cases, especially since they can't take even care of the basics. I'm sure the taxpayers will very happy to hear this news. /sarc

Thanks abb for all the relevant links. Durham gets uglier by the day. City PD corrupt (what is Chalmers hiding?) as well as payoffs by the NCCU police chief? This is really nuts!

Thanks for all the info on the "lineup"/"array"... whatever. Do you honestly believe any of the ID's will be thrown out? Just because the DPD didn't follow the suggested procedures for lineups, doesn't mean they were illegal. But I'm obviously not a lawyer. I have no faith in the Durham justice system. If the ID's are not allowed, the case crumbles. Not going to happen. IMO, this case won't go away until it's taken out of Durham.

I had that same thought. But I guess when it comes to the private political aspirations of public servants, taxpayer money is no object.

Maybe Chalmers wanted to distance himself from the case because he knows it's a crock.

Chalmers to retire??? I am seriesly stuned!

"It was wise on the chief's part to refrain from getting into the fray," Clement said.

There's an interesting response. The chief of police was wise to stay out of the fray, but Clement himself, Bell, Baker and Nifong were wise to get into the fray? It appears Chalmers didn't want any part of the Duke fray, lineup/photo array, et al. Maybe Chalmers is one of the few good guys.

That's why I'll have a flying pig moment if Titus actually does anything Monday. If he has an ounce of decency left in him--and that's all it would take--an OUNCE--he'd end this thing right now.

And it will never get moved out of Durham because no Durham judge will agree to that.

It seems all the Durham/NC judges are cut from the same cloth.

(I will eat my words, but only when I see some proof otherwise.)

And there must be some connection between Bayly in DC and Durham. Otherwise I can see no reason for the absurd trial and (probably pre-determined) conviction there.

My opinion of the judiciary sinks further every day.

He's been out of the "fray" from the beginning. I think he knows this girl. Now he's retiring. Interesting inded.

Maybe he wanted to distance himself because he is in this up to his ears, knowing many of the accuser side's cast of characters.

That's probably more likely, but we don't know yet. But is may be that he doesn't want this case to reflect poorly on him because he has post-retirement aspirations in a private sector business that will see this case for what it is. On the other hand, his announcement of retirement may be a way of saying, "Don't bother to investigate me - I'm leaving anyway."

It wouldn't shock me to learn that some of Chalmer's boys new the AV, hence the comment about checking the "young 'uns."

Either he's up to his elbows or not playing along.

Thinking out loud ...

Suppose he knew this case was a crock from the beginning, but Nifong, Bell, Baker, Clement, et al, wanted to proceed. Chalmers stepped aside allowing them to enter the "fray." In retaliation, the "fray" releases information on his daughter, and his daughter is arrested, (like the cabbie, etc.).

If that's the case I can understand Chalmers calling it quits.

Nifong stated he will attempt to try them separately.

At the first setting for Seligmann (May 18) Nifong said he would try the three together. I don't know if he has changed his position since then. I thought it would be better if he tried all three at once since the AV would only have to tell her story one time rather than three (who knows how many versions we would have during three trials).

District Attorney Mike Nifong said at the end of Thursday's brief hearing he intended to try all three players together. The prosecutor has said he doesn't expect any trial to begin before next year, and Superior Court Judge Ronald L. Stephens gave no indication he would put the lacrosse case on a fast track.

Rearrest LAX players on misdemeanor charges,
arrest Lil' Kim,
arrest ex-husband,
arrest boyfriend,
arrest cabbie,
arrest PC's daughter,
etc.

I agree. I do, however, recognize that this case is making national headlines everyday and the defense attorneys are wise for keeping it front and center. There's only so much injustice a court can render before the national exposure reveals the injustice. I'm not sure any judge is willing to lose all credibility in the eyes of the entire country, whether elected or appointed.

Maybe the arrest of the daughter was a warning shot as in , "You're next." This city scares me to death. My only hope is that the national attention keeps some of these characters honest.

The squad has done such a good job, he said, that Police Chief Steve Chalmers has mentioned publicly that he is interested in turning over the city's unserved warrants to the county.

At last count, the city had 10,200 unserved warrants, police spokeswoman Kammie Michael said.

Chalmers said in May he is interested in asking the Sheriff's Office for help with city warrants. Hill said he would be glad to help -- but needed more people and resources.

That's a theory I am kicking around. It fits the pattern. They still had the dirt on an older domestic violence charge, (which was dropped).
