Call adds mystery to lacrosse case (DukeLax)

Phone use spans time of team party

In the middle of a Duke lacrosse party where a dancer said she was gang-raped for 30 minutes, a call was placed from her cell phone to a Durham escort service.

The 12:26 a.m. call to the service, Centerfold, lasted one minute, according to a copy of her cell phone bill reviewed by The News & Observer. It is unclear whether the call was a request for another job, a cry for help or something else, or even whether the accuser made the call herself.

But the accuser's phone records add some details to the chronology of the March 13 party, a drunken spring break bash that spawned a national controversy.

Neither prosecutors nor defense lawyers would discuss the phone records Tuesday. Neither the accuser nor a second dancer at the party could be reached, nor could representatives of Centerfold. Police Chief Steve Chalmers was out of town; his spokeswoman said he would not discuss the case.

Three players have been charged with first-degree rape, sexual offense and kidnapping: Reade Seligmann, 20, of Essex Fells, N.J.; Collin Finnerty, 19, of Garden City, N.Y.; and Dave Evans, 23, of Bethesda, Md. Lawyers for the players have proclaimed their clients' innocence and said no rape or sex occurred at the house at 610 N. Buchanan Blvd.

District Attorney Mike Nifong, whose handling of the case has undergone national scrutiny, has been adamant that the woman was raped at the party. Nifong has not given a precise timeline of when he thinks an assault occurred.

You realize that there was always the actual possibility
that at the end of that trial he might be sentenced and taken directly to the DC jail (not even being allowed out until his appeals were heard)? That would be the worse case scenario;
but until the judge actually pronounced the sentence, that had to be in everyone's mind as a possibility. (And you can imagine the reception he would get there.)
Hard to keep your mind on the trial while you are wondering how it is all going to end (while having good reason for thinking the deck has been stacked against you already).

I think it will take a Federal Investigation into the prosecution of the case to get Nifong to drop it, short of that, it's going to court, IMO.

It looks like Cheeks isn't too interested in running for DA too. So, I think Nifong is insulated from all this. He knows that every day Cheeks lingers without deciding, he's losing backing, support, and money.

Prosecutors rejected a sexual assault claim against Lakers center Kwame Brown on Tuesday because of a lack of evidence.

The allegation was made during the Lakers' first-round Western Conference playoff series with Phoenix and had been under investigation since. Brown, who was not arrested, said at the time he was innocent.

"I am gratified that the authorities have come to the same conclusion and that the matter is being dropped," he said in a statement issued Tuesday through his agent. "I have been upset and frustrated to be wrongly and very publicly accused of something that I did not do and to have my name and reputation so unfairly damaged."

Deputy District Attorney Darci Johnson wrote in an evaluation of the case that the decision not to prosecute was made after "a MEDICAL EXAM of the victim was reviewed and revealed no signs of forcible sexual assault." There was also no corroborating forensic evidence found and Brown's attorney refused to allow him to talk to police......

Ditto my remarks, of course, for Collin's parents and family, who must have known that there was always that possiblity in the background (even if not likely, you never know for certain until the judge speaks).

Collin also had to spend about the last three months under virtual house arrest, lest he go outside and be tagged by the police somewhere for any kind of infraction (and maybe even set up). Certainly there was the email to Wonkette, and the failure of the judges office to inform him that Collin had been granted permission to miss a curfew.

So naturally with that, and the judges remarks in the courtroom, he had to have felt that there might be
a deliberate attempt to get him jailed, also.

I agree Collin seems very fragile and I pray for him and his family too. Also for Reade and Dave and their families.

I'm so sorry your family had a similar experience. I'm glad you came through it although I can't even imagine how difficult it must have been. This case sure has opened my eyes to things.

I know. He could have been sentenced to jail time and that would have been horrible.

I didn't mean to sound flippant with my remarks. I pray for Collin and his family every day. For Reade and Dave and their families too. I really worry about them and hope they're doing okay.

I no longer rush to judgment. I try to see all sides, but having been in the shoes of these families, as have others on these Duke threads, we know how flawed even our best attempts at justice are. I take my Jury Duty very seriously now. We've all been too lax in our civic duty and our chickens are coming home to roost. Never again, so long as I draw breath.

Unless the client is out of his mind, he would not discourage his attorney from moving to dismiss. Usually such motions are not filed until all discovery is complete, so stating they will not file a motion to dismiss may be a strategical maneuver at this point and they may well file it when they think the time is right. They may be looking for evidence of corruption as part of a multi-pronged basis for a motion to dismiss (besides the lack of evidence), assuming momentarily that they're actually onto police or DA conduct that is corrupt or malfeasant in nature. Right now, we're just reading tea leaves.

Oh, Mike, I know. I've tried to stay away from the issue as it sounds so ridiculous, but it is open seaons on white boys. It's not about correcting past mistakes, it's about payback. I'd never let my son hear me say that, as I want him to be free from prejudice, but in my heart, I know it's true.

I agree it was an unusual and inappropriate use of resources and attention, and I, too, find it suspicious. I also wonder how many first-time black offenders in DC get such attention and a harsh sentence (although the record can be expunged later). This case is becoming more political all the time. What is Bennett doing about this? It seems to me that his role in this should address that angle of the case.

I do too. I would like to see Megyn Kendall become the defense's point person in the media. She's the only talking head sharp enough to grasp the entire picture. The rest of them talk about this part or that part, but they never connect the dots.

Those escort agency operators do often operate under more than one company name and they often pay off the local cops to look the other way and even to pressure new competitors to their local market. If I was a detective hired by the defense, I would be looking to get some dirt on one or more members of DPD's vice squad.

How about this: Mangum got ripped off by Kim and wanted to get a quick gig from another agency so she'd have some cash to pay over to her main pimp without him knowing she got ripped off or not paid because she was so hammered?
