Lacrosse Scandal: The Duke Accuser—New Credibility Questions (Newsweek)

Early in the Duke lacrosse rape investigation, Durham District Attorney Mike Nifong, who was in a close race to keep his job, spoke about the physical and emotional trauma the alleged victim had suffered at the hands of the players. A police affidavit stated that her medical records revealed the victim had "injuries consistent with being raped and sexually assaulted vaginally and anally." But according to a motion filed by defense attorneys last week, no such physical trauma was found during her exam at Duke hospital. Quoting from the report, which was submitted to the court under seal, the motion states that the nurse—who was in training—examined the woman's entire pelvic region and noted only diffuse swelling of the vaginal walls, a condition explainable by consensual sexual activity.

Police documents indicate that the accuser had in fact engaged in such activity in the days leading up to the incident. The accuser told police that she'd had sex with her boyfriend a week before. She added that she'd also performed using a vibrator in front of a couple. (Though the timing of this incident is not specific, the clear implication is that it had happened near the time of the lacrosse party.) And, according to defense attorneys, the boyfriend's seminal fluid was found in her, suggesting she'd also had sex with him within 72 hours. Jarriel Johnson, who identified himself as the woman's driver, told police in a statement that in addition to sleeping with the accuser himself a week prior to the party, he'd taken her to several appointments at hotels in the days before.

Why would Reade be expected to be present for a search of premises he doesn't own or rent, though?

It must be the pills, but I am still not sure.

Yes, going over it again, I find only #3 to be interesting now. Number 1 and 2 do not mean what I thought they did, but #3 is a clue to something we haven't heard much about.

It is 3 am. The route from brain to keyboard is a bit fuzzy right now.  Let me see if I can make a bit of sense.  The big question is why?  Why has Nifong pursued this loser of a case, seemingly opening himself up to charges of prosecutorial misconduct? 

Keep it simple.

It was a no brainer. Poor black girl raped by mean white boys.  A race whore's dream. They had a victim. Race whores want power.  Nifong had a means to an end.  He pandered.  Was a deal made?  Probably in a roundabout way.

But  it took on a life of its own.  Durham is used to doing things Durham's way.  They did not anticipate the national attention.  What was to have been a simple deal among the corrupt now threatens to expose the connections among the power brokers.

The escort/strip club industry thrives in the Durham area. For it to thrive for so long, it must have some sort of protection. IOW, what do the powers that be get in return for looking the other way?

If this goes to trial, Nifong will be excoriated.  He is between a rock and a hard place.  He cannot drop it.  If it goes forward, the defense attorneys will hold nothing back..  Knowing what I know, if I was a parent of one of these boys, I would want nothing less than complete exoneration for my son.  Their lives have been devastated by this and I would want nothing less than heads on platters.

Sooo, I think that this is important not because of what happened in the beginning, but where it might end. And it probably scares the hell out of a lot of Durham officials who are starting to worry about exposure.

Where there are whores, there are drugs.  Where there are whores and drugs, there is organized crime.  I am not inferring that Clement is a drug dealer...But in terms of bribes and favors, who knows whose hands are dirty?

Gotta get some sleep.  Will wake up tomorrow, reread this and think "What the hell was I thinking?  Makes no sense at all", LOL!

Why present them at trial if traces were not found in CGM?,p> Exactly. Unless a blood test toxicology report indicates the presence of a date rape drug, merely finding date rape drug pills would merely tell that someone was in possession of an illegal subsance, not that they committed a rape -- especially in this case, where there is really no evidence of a rape.

I have to ask this obvious question: Why is Clement voting on matters that affect his own brother-in-law? Basic conflict of interest ethics should prevent him from doing such. Has no one questioned him on these votes?

Mike, when you remember the lineup that was done and the fact that she identified a fourth player this does start to make sense. It didn't fit so you must indict, but only three. Now we don't just have 3 attackers or 4 attackers, we have 5. That really doesn't fit. Without being privy to all the details that went on it is pretty hard to figure out what those people running the show were thinking, if they were thinking at all. The DA's case has more loose ends than a string mop. And they didn't bother to try to tie any of them up.

I believe someplace in my faulty memory, I remember that Seligmann's and Finnerty's dorm rooms were searched after their "arrests". I don't believe either one was present. Maybe someone with good searching capabilities can find that information.

Let's see ~ it's being hypothesized in the thread that "date rape drug" pills were found somewhere.

So, how does anyone "tie" those pills to the AV?

Simple ~ with or without a toxicology test/report, there would be symptoms consistent with the chemicals found.

I think that takes us back to discussions of the topic way back in April ~ they drew quite aggressive responses from a number of commenters who appear to have personal knowledge of individuals involved in the case.

At the moment, absent a report that such pills were found, I'm not willing to carry this beyond speculation ~ although in April I suggested that one individual might well have set about providing himself with an alibi in the face of the evidence that such pills might have been used.

Note, this does not mean a rape took place, or that any other crime than poisoning occurred (although, for the life of me, I can't imagine zoning laws in Durham to have been so flexible that operating a dive in a private home replete with dancing hookers has actually become legally, if not morally, acceptable).

Note, earlier reports were that the AV was taken (by police or others) to a Detox Center in the area, and those folks may well have done a few tests. Haven't seen anything more about the Detox people but find it difficult to believe they'd fail to check the woman out.

Others might well know one way or the other.

They can't, by law, test her without her explicit permission in NC. Once she said rape, it's a right of hers.

I have a hard time believing someone would plan to use date-rape drugs and plan an alibi and then leave the pills at the scene of the crime for 60 hours.

It'd have to be the chemicals that could have been found in the rugs seized for evidence ~ not the pills themselves ~ unless this whole business is pointing to something kept in a dorm room.

Frankly, I can believe crooks are dumb though.

Presumably stuff gets puked up, sweated out, spilled, urinated and so forth.

I really don't know how delicately this particular "smoker" was conducted of course, but it'd be my guess the rugs might well be a good place to start looking for drug traces.
