Lacrosse Scandal: The Duke Accuser—New Credibility Questions (Newsweek)

Early in the Duke lacrosse rape investigation, Durham District Attorney Mike Nifong, who was in a close race to keep his job, spoke about the physical and emotional trauma the alleged victim had suffered at the hands of the players. A police affidavit stated that her medical records revealed the victim had "injuries consistent with being raped and sexually assaulted vaginally and anally." But according to a motion filed by defense attorneys last week, no such physical trauma was found during her exam at Duke hospital. Quoting from the report, which was submitted to the court under seal, the motion states that the nurse—who was in training—examined the woman's entire pelvic region and noted only diffuse swelling of the vaginal walls, a condition explainable by consensual sexual activity.

Police documents indicate that the accuser had in fact engaged in such activity in the days leading up to the incident. The accuser told police that she'd had sex with her boyfriend a week before. She added that she'd also performed using a vibrator in front of a couple. (Though the timing of this incident is not specific, the clear implication is that it had happened near the time of the lacrosse party.) And, according to defense attorneys, the boyfriend's seminal fluid was found in her, suggesting she'd also had sex with him within 72 hours. Jarriel Johnson, who identified himself as the woman's driver, told police in a statement that in addition to sleeping with the accuser himself a week prior to the party, he'd taken her to several appointments at hotels in the days before.

There's actually a pretty good winery called Chatham Hill in Morrisville just south of the airport. It was started and run by a Polish chemist who did it as a hobby and then ended up turning it into a full time job. They buy from vineyards in the Yadkin River valley. OK, so it's not Napa and Sonoma but they do pretty well considering. Their problem is getting a clientele that appreciates a better class of product.

Someone promised Nifong a judgeship, IMO. Ain't gonna happen. He "played along" but I suspect he will soon be thrown under the bus. Clement, Bell, butt-boy Baker, et al, will go unscathed. And, Chalmers, whereeverthehellheis, will also survive. After all, wasn't he tending to his "gravely ill" mother when the questionable lineup took place? /sarc.

Still can't figure out why these boys would put so much on the line for a "precious," "one-on-one," "exotic dancer." Is one of the power playa's connected via family, prostitution, drug dealing, etc.? Or, is it strictly a power play against the all powerful, wealthy, and predominately white Duke institution?

Maybe a question to ask is "who runs the town?"

Aside from the obvious corruption in the Durham government, who runs the Durham criminal element, who is the big fish?

Who does Durham belong to? Who owns Durham?

Especially during a manic episode, which it sounds like Mangum was in the midst of during the night in question. People who are bipolar, during a severe mood swing, have difficulty thinking rationally, which is why the question..."why would she lie about being raped?"...is irrevelant.

If you know someone who is bipolar, then you know not to ask why did they max out their credit cards or cheat on their spouse. Their behavior is simply irrational at times.

I'm telling you -- there is something behind all this that will probably bring the entire Durham "house" down. Just one of those gut feelings.

Normally, I would disagree.

However, in this case, there is too much illogical behavior, too much lying, too many contradictions, too many rushes to convince the press and public erroneously.

What are we to believe? That no one involved read the case file? That the DA did 70+ National interviews and never looked at the case file? That it's standard procedure in Durham to serve 3 year old warrants (Cab Driver)in a case where someone has already plead guilty and been sentenced?
That Patrick Baker lied when he said he conducted an informal review and that the woman never changed her story - lied for the sake of lying? That Nifong regularly threatens lawyers that oppose him in cases? Are we supposed to believe that Nifong used abhorrently bad judgement in his determination that Crystal was credible enough to proceed on her word alone? That no one on the inside of this investigation gave pause when they found out Crystal was accusing Kim of sexually assualting her and when she claimed that it was Kim that Stole her money?

You'd be challenged to assemble 4 or 5 people that incompetent.

Nifong had to have seen it as his hail mary save to get elected and then on to being a judge.

He must have gotten tunnel vision and refused to listen and refused to see the truth.

He tended to be that way anyway, and the election just made him worse. He latched on to CGM like a drowning man to a lifeboat.

Now he is too far in and can't get out.

I think he has ruined his long term chances for a short term gain.
