The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

she first claimed she was reading the actual police summaries of what Kim said happened and then said the stuff about looking for AV, and said this is why her statement of the allegation being a"crock" should not be allowed because she was in her car during the rape and therefore was only speculating....
Sure, because at that time Kim knew she was in trouble over her restitution and probation violation issues, so she would have done her best to cooperate fully, which, early on, she would have perceived as strictly telling the whole and complete truth.
So, you're saying Chalmers is out of town because he wants to hide from the defense so he doesn't have to butt heads with the city manager and Nifong? Or what?
This is all speculation on what's going to be admitted because there's not going to be a trial. ( I cringed when I realized that NG doesn't think so either. OTOH, I've been saying it for a lot longer.)
The police chief has been MIA since late March, early April. The reason given was that he was taking time off to care for his "gravely" ill mother. God bless her, Mom has been hanging in there for over two months.
Back in February, 2006, Chalmers put in place the General Order 4077 on Eyewitness Identification which calls for an independent administrator to run the lineup, not the primary investigator, and the lineup should include five "fillers" -- people who have no connection to the case -- for every suspect, to protect against faulty identification. The Duke LAX lineup ran contrary to those guidelines.

That won't get Nifong around two important issues: 1. Before her arrest, Kim would have wanted to be as cooperative and honest as possible, thinking the truth was what they wanted. 2. After influencing Kim to discredit herself after Nifong cut her the deal on the bail and probation, he still has no valid legal reason for not including her statement in the probable cause affidavit, except to claim he was unaware of it because Himan had not submitted it to him. That is not going to fly at all unless Himan is willing to take the fall for it by refusing to tell that he was encouraged to not turn over any exculpatory evidence to Nifong instead of letting Nifong take the fall for his own doing. I would be very surprised that Himan took it upon himself to hold back relevant statements going directly to probable cause.
I think Kim was told or signaled that her original statement would not see the light of day because before this original statement of hers came out, she was denying the story she gave the defense early on, which was likely nearly identical to the original statement she gave the cops. As a side point, this also suggests that she's still trying to maintain credibility.

The main side effect of Flexeril mixed with alcohol is dizziness. She wouldn't have needed anything else to put her in the shape she was in. I think she drank a lot and took a larger dose of the Flex than perscribed, and that put her into a falling-down-drunk condition.
Howlin has lost her father, her sister, her son, and now her mother. She is in a world of hurt, and my heart goes out to her. Pray for some measure of comfort for her and her family at this difficult time.

Why would she be told that? It makes it sound like they intended to bury it.
I would not be shocked if the dancer/stripper/one-on-one/prostitute was also an addict. The extra $$ may be supporting her habit.
