The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Reading Kim's statement it seems as if Prescious can't handle stress.
When she is stressed, she flips, becomes mental, looney, crazy, hysterical, whatever.
Jarriel described an incident as did the manager of that strip club several years ago. IOW, Crystal is crazy.
Also reading the statement, I believe it is about an honest of an account as Kim can give. My gut tells me she was pretty honest when she was writing.

No sure, Peach, but the defense is arguing that the the lineup and any identifications obtained from it should be thrown out. I think this is why Chalmers has not been seen.

The lineup procedure ran contrary in two fundamental ways to the police department's General Order 4077 on Eyewitness Identification issued in February.
* Policy calls for an independent administrator to run the lineup, not the primary investigator. This avoids any unintentional influence from the investigator.
* The lineup should include five "fillers" -- people who have no connection to the case -- for every suspect, to protect against faulty identification. If an accuser picks a filler photograph, the defense is certain to challenge that witness's reliability.
I've put in a phone call to a neighbor who is an attorney but they're out of town until Sunday night. It sounds like a huge deal to me, accusing Nifong of violating the Constitution.

Her original statement backed up the story the boys told, so part of the DA's deal was to have her discredit herself so none of her testimony would be credible. JMO

Precious was drinking with Johnson, then Taylor, and at the party. I think the Flexeril is a ruse for usage of other narcotics. She may actually have or had a prescription for the muscle relaxer.
One of the funnier highlights from the police report is the breaking of an ammonium capsule under Crystal's nose, whereby she then began breathing from her mouth, indicating that she was faking being passed out.

The backache comment was a reference to President Kennedy who told somebody (Krushchev?) that he got a backache if he didn't get 'it' for more than two days.
