The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

I mean the part about Kim stealing her money and property, not the sexual assault part.
Here's the caution about Flexiril and alcohol: http://www.drugs.com/flexeril.html DIZZINESS is the big side effect - as in dizzy enough to fall down steps and not be able to stand without leaning and certainly not able to dance.
Mangum told the medical people the next day that she had been drinking heavily the night before. I wonder how much Flexiril she took? More than the regular dose? I wonder if she wanted to retract her story at that time by laying it off to the excessive alcohol consumption?
We had a discussion here about a week or so ago about the preliminary tox screen done for illegal drugs and in connection with date-rape drugs, which was negative. I said then that the only explanation for Mangum's condition was prescription drugs, and it appears that is correct.
This totally undermines Roberts' changed story that Mangum was fine when she arrived, and supports Roberts' original story that Mangum was out of it and "loopy" from the start.
What is really sweet about this new information is that Mangum clearly believed that Roberts ripped her off.
Imagine being so out of it, knowing you had no money to hand over to your pimp who might beat you (again - she had old bruises), being a whore in the first place, you're sitting in the car with the person who ripped you off, but you can't get out to go face your pimp, you're drunk on your ass and on pain pills, and the next thing you know the cops want to have you committed. Geez, I almost feel sorry for her, and I would if she hadn't gone forward with this thing. Then she falls into Nifong's clutches, and they're off and running - a devil's match if ever there was one. I think Nifong has taken advantage of a weak, pathetic person to advance his career through political manipulation of the electorate, at the expense of a great deal of pain and humiliation for these boys and possibly Mangum, who is just too weak and f-----d of a person up to stand up to his steamrolling. The truth of her character will be shown when it's learned whether or not she files civil suits. Right now I have to wonder.
The more I learn about this case, the more blame I place on Nifong's doorstep.
I think Jarriel is the boyfriend.
Some of the information in the article must be coming from new material the defense obtained that was NOT in the 1300 pages that Nifong turned over. Is that your take?
Jeral Johnson's name was in the papers when he was mentioned as the guy who drove her to the DPD station to pick up her property the next day. His was the first name speculated about as the "boyfriend."
I guess I don't understand this ... If Jarriel is really the boyfriend and not the "boyfriend", how can he so casually say that Mangum had sex with 4 men over 2 days without going ballistic?
I am so behind on these threads, but I wondered if you all know that the first rape kit test was inconclusive?
LOL
Tom, you quoted a really important passage in the article: "Osborn says a man named Jarriel Johnson drove the accuser to the Durham Police Department to pick up her belongings March 21. The motion points to a statement from Johnson saying the accuser engaged in sexual activity with at least four different men from March 10 to March 12."
The reason I think this is so important is because it supports the idea that Mangum wanted to bail out of this accusation early on. There would be no other purpose in Johnson making this statement to the police. The statement would clearly be something said by someone who wanted to "dilute" and cast doubt on any evidence of a rape by throwing a great deal of doubt on where any injuries, semen, etc. came from, similar to the widely publicized Kobe case. Combine this with Mangum's statement to UNC Medical that she drank a great deal of alcohol the night before, and a picture of an effort to recant or muddy the case appears.

Motion: Second Dancer Initially Called Lacrosse Rape Allegations 'A Crock'

You're kidding, right?
There was more than one?
From the WRAL article:
Wednesday's motion also claims that the initial examination performed on the alleged victim did not reach a conclusion as to whether she was raped and that the only trace of physical trauma included a scratch on the alleged victim's knee and heel.
Osborn writes that the alleged victim said she was hit, kicked and strangled, but that the investigator in the case, Benjamin Himan, omitted that "the examining physician
at 3:14 a.m. [on March 14] found no neck, back, chest or abdominal tenderness."
He also writes that the investigator's probable cause affidavit omitted that the sexual assault examination found that "no condoms, fingers or foreign objects were used during the alleged sexual assault."
The motion also states that the nurse who did the examination was not technically certified as a sexual-assault nurse, but that she was still "in training."
What do you mean by "inconclusive"?
"She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer"
Colt 45 in the "convenient" sizes.
What possible reason does Nifong have for issuing 2 subpoenas for Duke to give him the home addresses of other non-indicted team members?
