The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Remember, just days ago, Nifong was filing more subpoenas for more information and more digging on the entire team!

All that can be done is file a motion to dismiss. I have sat in stunned amazement since the inception of this case when I learned there is no actual probable cause hearing process in which the defense can cross-examine the DA's prima facie case or present alibi and exculpatory evidence. In NC, the GJ process serves the gatekeeping function, but there is no requirement for the DA to present exculpatory evidence. What was remarkable in this case was the DA's refusal to even look at that information, which was the only ethical recourse under a GJ system that does not require presentation of exculpatory evidence. The GJ has the right to ask questions and seek further information, but most GJs are simply rubber stamps for the DA and don't seek other information. The GJ let these boys down, too.

How could LIEfong proceed with this case? Did he read ANY of the victim's various statements?

So, as we thought, we had a previous "engagement" where she probably got her "injuries" that looked like a possible rape to the nurse but were in fact inflicted by the stripper on herself.
Her changing stories about alcohol and not taking drugs when in fact she'd taken a flexeril are interesting too. I've taken flexeril many times for pinched nerves and if I was ever dumb enough to take alcohol with it, I'd be on the floor. Which the stripper pretty much was.
