A Felon that was wanted the very night of the party
He is hoping one or more of them get arrested this summer on some misdemeanor charge or other and then they will be more vulnerable to pressure.
The judge doesn't have to approve a photo line-up, or any line-up, but he would the search warrant of the property and for the DNA samples taken from the boys.
The question is, did Nifong in some way signal Himan and other DPD investigators that he didn't want full reports that included exculpatory evidence.
The defense's motion granted at the last hearing to order all LE to preseve all notes and records was a master stroke and it clearly indicates that the defense knew or suspected that this or something along these lines had been going on between Nifong and at least Himan. Now, this motion puts Himan on the spot - his butt is on the line - and we'll see if he spills his guts about who told him to omit what and when. The defense should bring misconduct charges against Himan right away and squeeze him. Maybe they have more to develop yet, thouogh.
Perhaps Brian Taylor lives in Raleigh (info the N&O article left out). GCM arrives at his place at 9pm, after her "appointment" with the couple in the hotel room, and then they leave at 10:45 to go to Buchanan. Driving from Raliegh would explain her late arrival (not to mention, sexual favors in exchange for such a long distance ride).
It's too far-fetched, imo, and Roberts is too flaky. Such an agreement would have been struck shortly after her arrest on her warrant, and she would not have made those statements aboout no rape occurring as far as she knows publicly. In more recent weeks, she has said she does think a rape occurred and is sorry she didn't do more to check on Mangum, etc.. There may even be something to that effect in the Vanity Fair article that came out earlier this week. She would not be making such statements if she had a deal with Nifong that you describe. Further, I doubt that Nifong has the authority to waive her repayment of restitution because that is money owed to a private entity, not the government, and is part of a court order.

This is, of course, the defense attorney's version, which should be approached with the same amount of suspiciion as the DA's version but this explains why the prosecution has to give *all* evidence to the defense before trial, not just the parts that support their case. These details paint a very different picture than the prosecution's.

Because she was whacked out on Flexeril and booze? That said, I'm not saying this is what happened. I just have to wonder why she would be prescribed a muscle relaxant. With her alleged history, that is.
Flexeril isn't considered a recreation drug. She might have a prescription for it. She didn't have to submit to any toxicology or alcohol testing, nor did she even have to mention it when asked about any drugs or alcohol, so she may not have been trying to hide the fact that she took it. There was a bottle of pills found among her things left behind at the lax house.
None. Zero, zip, nada. He's even more devoid of ethics.
Do you think the defense is getting them via a subpoena from the court, or are you thinking in terms of a sympathetic individual in the DPD?
I hope you are right. The deal would have had to been made when she was arrested for her probation violation.
But having a corroberating witness that early in the case would certainly limit Nifong's legal liability. Certainly Roberts is a loose cannon and has said conflicting things after she would have had to agree to this deal. But still I wonder if Nifong would dare try this.
