Police: Dancer Called Rape Allegation a 'Crock'

The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.

The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.

She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

I don't know anything about that area, but on another board they were saying she went to another hospital the next day. This is the quote they are using...

I'm extremely curious about this aspect of the motion, too. What, exactly, was withheld?

It sounds to me like the defense has been getting the documents they were seeking directly from DPD.

I was thinking the same thing. Could there be someone in the DPD who is starting to get sympathetic to the defense. LIEfong's unethical behavior in this case will only make DPD work more difficult over the next four years. Perhaps there is a movement within the department to sabotage the case and ultimately force out LIEfong?

And where is the Police Chief? Is he STILL on leave???

It sounds to me that that part of the motion is saying that they withheld certain exculpatory evidence from the judge who would have had to sign off on photo lineup and other searches. She was making contradictory statements from day one, so much so that the investigation should have never gotten anyway near as far as it did.

No. Kim Roberts pleas to abetting a rape, get one month probation and testifies against Evans, Finnerty and Seligmann. Nifong scrubbs her restitutions and prior porbation and she is probably ignorant of the implications of registering.

I will say that your conspiracy theory is the first thing I've seen on this thread that plausibly makes sense for LIEfong's case. It's far-fetched and about as unethical as anything I've ever witnessed, but this case is going down in the history books anyhow so why not add some forced testimony as well? Your scenario is the only thing that makes any sense for LIEfong. How sad is that?

I don't think it will work, but I really fear that is what he is going to try to pull. Roberts is amoral enough to go along with it. And it is sad but consistent with arresting the cabbie.

Are you saying there were two rape kits done? Two separate examinations? What, exactly?

No vaild reason, except to harrass them without their attorneys present, or to hire private dicks at the taxpayer's expense to follow them around to see if they say anything incriminating about the accused, or to get wiretaps to listen to their phone calls and then seize their computers and emails at the end of the summer to see if there's anything incriminating that he can use to keep this case alive. I also would not be surprised if he was to turn the address information over to his buddy, Malik Shabazz, on the sly so he and his thugs can harrass them over the summer. There's little I would put beyond Nifong's skullduggery at this point. It just gets worse and worse for him as the defense builds a nice civil rights case against him and Durham County.

I don't buy that- when someone pleads guilty, they are questioned at length about whether they understand the plea and its implications. If she were to be required to register as a sex offender, they would have to say so and explain it in open court. There is no slipping it under the table.

Why? Lots of people who are guilty originally say nothing happened or they were not there later testify in court against their accomplices.

This is similar to why an exception to the hearsay rule is statements against your own interest. Odds are you are not lying then. Nifong will argue Roberts lied about no raped because she was criminally liable and now she is telling the truth.

Now, I haven't read every word, but I would caution everyone, in regard to the flexiril we shouldn't assume she had a prescription.

I'm not even sure that is legal. Besides, based on Roberts public testimony, wouldn't she be impeached as a witness? Again though, your post was the only thing that remotely makes sense for the LIEfong case. Mangum just needs to come out and say that Kim Roberts stole her money and that she made up the rape allegation so (fill in the blank...probation revoked?...social services taking the little ones?...drug violation with unprescribed Flexeril?).

What a mess.

Well, if that's really the case, then it explains why he avoided getting any (exculpatory evidence offered to him) and rushed in to get his indictments before any could be rammed down his lying throat.

Are you sure he's required to present exculpatory evidence? I have heard NC attorneys state on the talking head shows once or twice that it's not required, and that the GJ has the right to further investigate.

So Jesse Jackson and his organizations are giving scholarships to whores/dancers who perform with vibrators? This should do the racists who back her proud IMO.
