Lawyers representing one of three Duke University lacrosse players charged with rape want details about any toxicology tests performed on the accuser, asking in a motion filed Monday whether such evidence even exists.
"No such toxicology report, if it exists, was provided to the defense," wrote attorneys Kirk Osborn and Ernest Conner, referring to nearly 1,300 pages of evidence prosecutors provided to defense attorneys last week. The attorneys represent Reade Seligmann, one of three lacrosse players charged with raping a woman hired to perform as a stripper at a March 13 team party.
Seligmann's attorneys want a judge to order prosecutors to provide any reports "generated from blood, urine or other biological samples" collected from the accuser. In the motion, they cited a story published in Newsweek earlier this month that said District Attorney Mike Nifong "hinted" such tests would reveal the presence of a date-rape drug.
Authorities have said a doctor and specially trained nurse performed a physical exam on the accuser that found evidence of sexual assault. But the nurse who filled out a report on that exam indicted no toxicology tests were performed, according to the defense motion.
Nifong declined to comment.

The reason they're able to work with a face of legitimacy (and thus, also be able to advertise in phone books, etc.) is because the pimp gets the money and the activities of the "date" are arranged between the girl and the john. No money is given directly to the girl by the customer, unless it's a "tip" for a specialty service. because the pimp gets the payment, he simply states the customer paid for a date with a lady and what they do is between them and he has no knowledge of it. So neither one of them is subject to arrest for soliciting, pandering, or prostitution.

All our surmising is to anticipate what a DA without a conscience, i.e., Nifong, is likely to try to bring up as evidence. I would assume that a judge would rule it inadmissable - but given the record to date I am frankly not sure how a Nifong-friendly judge would rule.

That DU woman also thought she was an expert on all topics from prostitution to medicine to law. But then, what "dancer" isn't an expert in all those areas?
The best Nifong can hope for is that Crystal, like Kate Faber, refuses to testify and Nifong can say, "I did all I can, but I can't prosecute without the star witness!"
This is the most logical reason why he is trying for such a late trial date, the longer the process takes, the more likely Crystal will withdraw (chances are she may even have another mental breakdown before that, which would be convenient for Nifong).
But I think a lot of people are perceiving Nifong to be in a worse position than he is.
The ethics charges will come to little or nothing, the worst that is likely to happen is perhaps a letter of reprimand for having talked too much to the press initially or not agreeing to at least meet with defense lawyers before bringing charges.
Nothing will come of any claims of malicious prosecution or defamation or what have you against Nifong. Frankly, the most promising avenue from a purely legal perspective would be a Section 1983 civil rights claim, but these guys are the wrong skin color for the federal courts to take that seriously.
What people are complaining about essentially is abuse of prosecutorial discretion, in that Nifong should have used his discretion not to go forward with the case after considering the totality of the evidence. Yes he should have, but if he doesn't, there really is no legal remedy other than trying to get the judge to dismiss the charges for lack of evidence or relying on the jury itself to find not guilty.
Nifong's nomination is in the bag, and if the trial date is pushed to well back of November, very unlikely that anything dramatic will derail his actual election, which is unopposed.
And if the case actually goes to trial, and he loses, so what? Nifong still is District Attorney, and not every District Attorney wins every case.

Sure, it's possible another white car was somewhere in the vicinity, and this is what Elmostafa saw and confused it with the car Kim and Crystal were in.
On the other hand, he said guys were on both sides of the car arguing with the woman.
But there are more important details and less important details, and the color that Elmostafa saw is a less important detail. I believe it is a mistake for people to seize on this one detail by this one witness and try to build theories off of it that do not fit well with all of the other reported circumstances of the case.

He will certainly look very bad after all he has done and said if he loses in any way. His image may be the most important thing to him.
I don't think he will receive any reprimands at all. Whether he is disciplined or not may not matter. A slap on the wrist may actually make him look better in the eyes of the black community.
He actually called these boys names and physically demonstrated their attack on CGM in public. He went way out on that limb. He is going to look a fool if the case does not go to trial, imo.
The black community doesn't look like it will accept anything but convictions.

Yes. You know, I'm not nearly as eloquent as so many of the posters here on Free Republic are. But I have thought about this whole "race" thing a lot over the last couple of decades. It takes me time, I have to take it all in and then mull over what it all means, hence, I don't post here a lot.
But I wonder, can we EVER, as a nation, undo all the damage to to blacks in this country by well meaning but totally misguided social programs of the past few decades? This false accuser is a prime example of what went wrong. I mean, so many, many black American kids are born with that chip ALREADY on their shoulders. They are fed, in their baby bottles, the idea that because their ancestors were treated so badly, they are entitled to special treatment, now and forever. Like you say, they feel their skin color innoculates them from ANY form of disapproval.
I was raised to believe that if I screwed up in life I should first look to myself, my actions and behaviors that resulted in the outcome I so dislike. When you become an adult, YOU are responsible for yourself. If you behave badly, expect the consequences and don't yammer and belly ache about people not "respecting" you. You have to ask yourself, what have I done that is WORTHY of respect.
These women, and so many in that community, don't understand lesson number 1. If you want respect, you have to earn it by your actions.
I am sorry I wandered off into my own internal musings here, but when I see cases like this, when I see the black panthers coming out in support of the FA, when I see people like that utterly absurd woman whose stupidily was on display during that news conference outside the court house the other day, I just wonder, where in the world do we go from here, and HOW?
