At this stage, there MUST exist a complete rape report. Nifong cannot now represent that he doesn't have one or the dog ate it. If Nifong was publicly talking about a toxicology report he MUST explain to the defense why one has not been provided to them. The phone records by CGM are critical because the defense MUST know with whom she talked immediately after the "alleged rape," so that they too can know what she told them.

I suspect, as does everyone else, that the defense team is soon going to ask for a compulsory order from the judge directed to Nifong to comply with their requests. And then, if he is not forthcoming, the defense will put on a strong effort to have the case dismissed.

I've said all along that I didn't think she consented, but as for other parts of the medical report being missing from the discovery, I would chalk that up to Nifong being coy and playing fast and loose as usual because there's something he's hiding. He just has not wanted to give stuff up all along.
