It sounds as if the judge is simply having the case assigned to the court docket in the order it came up -- as opposed to "fast-tracking" it and bumping it to the top of the list.

I know it sounds like a slow process, but if I had a case on the docket that got pushed back just because this one got moved ahead of mine you can be sure I'd be very p!ssed off.

OK you make a fair point on that note Alberta, so I would offer the best way to deal with it is to show clearly WHY the backlog exists. Wouldn't you agree?

Yes but the lack of a speedy trial law is the complaint being raised here. I also think many criminal defendents don't want speedy trials because overtime evidence can degrade etc.

The innocent want a speedy trial usually. That is why the constitution promises it to them. On the plus side, if a racists Durham jury convicts on this flimsy evidence, there is certainly a federal issue.
