I read an article the other day that the DA knew his case was incredibly weak. It got him re-elected though, and now he's letting it drag out in hopes that the furror will die down and people will forget.

After the brief hearing, District Attorney Mike Nifong said he does not expect any trial to begin before next year.Why not? What is there to do?

Maybe some FReepers can help me understand something pertaining to this comment.
In every area that I have ever worked the demand for work to be done in a timely fashion demanded three or four shifts many times going 7 days a week and sometimes being 365 days a year. Why is it that our justice system seems to be immune from this evolution?
Is the show "Night Court" as close as we will ever come to actually doing something about this foolishness? SHEESH!

The Honorable Ronald L. Stephens Judge Stephens received his Juris Doctorate from the University of North Carolina at Chapel Hill. He was appointed special Superior Court Judge in 1994 before being elected in 1995. Prior to serving on the Superior Court bench,
Judge Stephens served as the District Attorney of Durham County, practiced law with his private firm of Pulley, Wainio, Stephens & Lambe, and also served as an U. S. Army Helicopter Pilot during the Vietnam War.
From Nifong's bio: In the course of his career as a prosecutor, Nifong has worked for three different District Attorneys, serving as Chief Assistant under both Ronald L. Stephens and James E. Hardin, Jr., both of whom now serve as Superior Court Judges. He was appointed District Attorney for Durham by Governor Mike Easley on April 18, 2005, and was sworn into that position on April 27, 2005.

Further, considering how this case has been handled so far, this is a scary statement by the judge if it is indicative of how justice is handled in North Carolina.

This is outrageous. This is a clear violation of the accused's Constitutional right to a speedy trial. Why the delay? Perhaps the DA is hoping that the furor will die down between now and then and he can quietly drop the charges? It's not right to have this smear on these men just hang out there for a year. Try them now...if they're guilty send to jail but if they're not they should be cleared and free to continue their lives.

I don't understand why the defense atty's have not gone in front of a judge, laid out their overwhelming evidence of the innocence of the accused, and ask a judge to not only drop all charges but to expunge these boys records.
A prosecutor may be able to indict a ham sandwich that doesn't mean the sandwich must sit there and wait to be eaten.

A talk show host in Dallas this morning said that yesterday in court, a member of the Black Panthers stood up from the audience, pointed a finger at the defendant, and said 'dead man walking'. Sounds like a death threat to me, but the man was only briefly detained and 'released to the Black Panther Organization'.

This case is a textbook example of why the so called justice system in North Carolina is in violation of the Constitution of the United States and needs to be forced into compliance, not after these young men and their families have been politically persecuted for a year or so, but right now!
The citizens of Durham can speed things along by quickly launching a petition to recall Nifang.

Greta on Fox yesterday: She was in court. A black man behind her was grumbling loudly, and finally, after the judge left, stood up and shouted "Dead Man Walking!" at the Duke student. She said was incredibly tense, a definite racial issue. It's going to get worse. The usual town vs. gown, plus have's and have nots, black and white. In the end, it won't matter to a lot of people if the accuser is lying and the defendants are innocent. White, privileged boys deserve a lynching.

How can something is flimsy and ridiculous go forward in our "justice" system? No need to answer, it was rhetorical. And if there in not some BIG smoking gun here to warrent a trial - Nifong should be recalled and prosecuted; whichever party he is.

This outrageous action represents additional evidence that we desperately need judicial reform! Are there any options or recourse for the defendants? Not only are white males disappearing from college campuses, but those that are there have big targets on their backs it seems, especially by the lesbian controlled feminists. How revolting.

Amendment VI : "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."
So, we've tossed out speedy. Let's see what other of his rights will be violated:
- Public trial: Might embarrass the prosecutor.
- Impartial jury: The prosecutor will now have a year to poison everyone.
- Venue: This will be protected, because the prosecutor wants his poisoned jury pool.
- Nature of the crime: I don't know about this one.
- Confronting witnesses: The alleged rapee will probably not have to testify.
- Witnesses in favor: They'll be excluded. The prosecution is already working on the taxi driver.
- Counsel: Okay, that one's being protected.
Doesn't look good for these kids.
