Turns out his statements were not even true (about the Tox), it seems Nifong expects to simply argue things when this is no factual basis (he is in Durham). I suspect he will try to change the timeline in the exact same fashion (Can you hear him saying: I know it clashes with some stories told here, but our investigators believe they were wrong and we've heard experts testify about how unreliable eyewitness testimony is).
Nifong has nothing more than a Jury pool eager to convict.
I have seen over 3 reports stating in North Carolina it is standard procedure to do a TOX test when a rape kit is taken.

Her actions are that of a criminal, from using some else's cell phone to canceling the service before the crime was investigated. To her girlfriend lying on a 911 call and then lying again to a security guard while the guard placed the second call.
The question is will it mean anything to that jury? I'm sure no one expects Nifong to change course. That should be apparent to all at this point.

That is the ticket. This is an easy case when it is removed from Durham. Remember there's a whole contingent in Durham attempting to prevent the Change of Venue. Wasn't that one of the Black Panthers demands?
Judge Stephens is elected. He has the same problem as Nifong. He is a white elected offical in a black city. He has to constantly prove his worth or he is out of a job. Judge Stephens is the same guy that said he wouldn't treat the is case any differently than any other (regardless of the evidence)!
Stephens and Nifong also know that as long as they take the side of the AV, the News Corspe will portray them as brave defenders of the downtrodden.
Maybe what needs to happen is what Sean Hannity has been calling for: the Feds to come and take over this investigation - take it away from the DDD (Dirty Durham District) control
Do you have links to any of those reports? Dr. Kobilinsky, the "expert" on the Abrams Report panel today, said it would not be unusual. At the very least, I would think it would be standard if there were even the slightest hint of intoxication.
I must say, every time I see this "expert", he seems to shade his answers in favor of Nifong's case.
If they believed Kim, they could have cut out that part of the rug and tested it. Not sure what it's worth though. You'd have a heck of a time proving anything about what you found. Especially with the delay and the fact that the house was not treated like a crime scene.

IIRC, the father said she was hospitalized in 05 for "nerves."
That could have been as recently as 4 months prior to her arriving at the house. It's hard to believe that she wasn't on medication.
