DURHAM -- A judge agreed Thursday to let the defense try to find out what information is on the cell phone of the exotic dancer who has accused three Duke lacrosse players of rape, and also ordered police to preserve their notes in the case.
The decisions came as the case of State v. Reade Seligmann saw its first day in court after weeks of sometimes stunning developments, press conferences, leaked documents and almost nonstop chatter.
With a trial likely still months away, the brief hearing was supposed to be nothing more than a chance for District Attorney Mike Nifong and defense attorney Kirk Osborn, representing one of the three Duke lacrosse players charged with first-degree rape, sexual offense and kidnapping, to settle some administrative issues.

How long was Stephens the DA? Did he hire Nifong? Nifong has been and ADA for 27 years. I'm not sure that makes him Stephens' protegée.
Could be. I just read their respective bios. Needless to say that Stephens would be very sympathetic to Nifong.
You can't assume that every prosecutor is like Nifong. Most prosecutors actually care about justice, a substantial minority is out of control. Freda Black worked with Nifong and hates his guts.
yeah, I looked up the codes, there was a general code 10 51 was drunk, and 10 56 was Suicide, but I found the NC codes (which may apply to many more states as well, 10 56 was intoxicated person.
thanks for the Abrams update, was this at the beginning of the show, or later?

You can easily find it on the web.

"I would not be surprised if condoms were used," Nifong said in an interview last month. "Probably an exotic dancer would not be your first choice for unprotected sex."
I agree... Also, do you really think he expects the defense attorneys, the judge, the cops and us morons watching that he doesn't know what's on the AV's cell phone? Are we to believe that with all the talk about cell phones, cell records and camera phones that no investigator has even peeked at what was on her phone. Can you imagine the egg on everyone's face if that phone contains pictures of the actual rape.
He should be recalled for not looking in the first place or if he did look, put in jail for lying to the court...
12/18/2006 following setting 1 hearing
the only single source male dna show it was someone other than a Duke lacrosse player...
05/12/2006 approx. 4:00 remaining in video...
from a vaginal swab the only single male source was named in the report...I suppose you could conclude that since they said there was nothing found "that could be matched with anybody", then there is some out for saying they found some that couldn't be matched...
snip..
no other male source, no other genetic material from her vagina, rectum, or oral cavity.. from any other source that could be matched with anybody...
" And personally, I don't think she was out like a light in Kim's car. She was faking that, too. "
Or having another one of her " spells."
Wasn't it reported that the FA's hands were wrapped around the stick shift and she wouldn't let go ?
Kim told the security guard that the FA " won't " get out of the car- not, that she " can't."
When Kim approached the Kroger guard ,she asked her to evict the FA- she didn't say-call an ambulance for my unconscious associate.
"I would not be surprised if condoms were used," Nifong said
ABRAMS REPORT, April 7
ABRAMS: But she would have told you, would she have not? I mean you've spoken to her. She would have said either they used condoms or they didn't.
NIFONG: Well, if you are being forced to have sex against your will, you may not necessarily notice whether or not somebody behind you is using a condom.
"Again -- you are basing your 'logic' on the 'seriousness of the charge'"
Come again.
It's me, the guy who posted #9:
"the seriousness of the charge is only one consideration in determining bail"
Maybe you meant to reply to Jezebelle? She's the one who thinks that, given the seriousness of the charge, bail was set too high. So it's her "logic" that's based on the seriousness of the charge. I'm sure if you reply to her #9 and take her to task, she'll get the memo sooner or later.
"a murderer in the same county was freed on $50k bail, rich young white boys bail was set at $400k."
Is the (accused?) murdurer rich?
You know that's relevant, right?
Good find.
I see. He's playing at... "you show me yours and I won't show you mine."
"Get yourself a new crystal ball"
If Jezebelle told me she hated traffic and I knew she lived in LA and commuted to work, I'd think she'd find her commute frustrating -- not because I have a crystal ball, but because it's a well-drawn inference from the facts.
If Jezebelle tells me she's furious because I defendant had to borrow money to make bail, and I know lots and lots and lots of defendents do, I'd think she'd be furious with pretty much all criminal cases -- not because I have a crystal ball, but because it's a well-drawn inference from the facts.
"Jezebelle's point is that Nifong is a vengeful little prick, very unprofessional and highly unethical."
Thanks :-)
Did you happen to catch her reason for thinking so? I looked in vain but missed it. If you could cite me the post, I'd be much obliged.
I always go back to: None of these boys were desparate enough to have sex with either Kim or Crystal. And unprotected sex?? Who the hell knows what she'c carrying.
"None of these boys were desparate enough to have sex with either Kim or Crystal."
How do you know that? For all I know, they were turned on by the idea of gang-raping a black woman. Look at Hugh Grant. They guy was nowhere near desperate yet he paid an UGLY hooker $20 for oral sex in a car. I forget the name of his fiance at the time, but man she was HOT. No way to make sense of it except that he was turned on by the fact she was a low-rent black hooker.
