Maybe I jumped to conclusions. I thought the judge said that he understood that the phone belonged to a third party, and, therefore, he didn't want information released until it was reviewed in chambers as some of it may need to be kept private.
You cancel your cell phone service as soon as the police have it because it is out of your control and if not found by the police yet, lost. Who wants to pay for a cell you no longer have and you know will be evidence and you wont get it back for some time?
I think even if assaulted someone might do that. However if injured by a broomstick, one might not be calling around and changing cell phone service?

It's two months later. If that cell phone depends on a live battery to retain information then it's already dead unless it's been somewhere on life support.
I would not like the idea of my sons hiring a stripper to come to their house (YUCK!!), but stepping back, looking at the big picture, it wasn't that big of a deal.
But they have learned a life lesson. As I said before--they will be the stronger for it.
Well, if I was assualted and raped by three men, I don't think cancelling my phone would be my first priority.....I bet the phone belonged to her boyfriend/pimp....or whatever!
I agree. What is in those 1248 pages he turned over to the defense? Remember all the computers, cell phones, cameras, etc. the search warrant listed? I think he only turned over 2 VHS tapes and a compact disc with photos.
I doubt he cares about the PR battle.

The cops should have turned the phone off when they got it. But then again, we are talking Barney Fife-ville here.

I've served on 2 juries, 1 civil and 1 criminal, in the past, in Salisbury, NC (the county seat), and both times the DA and the judge were fair. I had mixed feelings about the skill of the defense attorneys at those times.

As one of the TH's said, Nifong would be putting it out in the open if he had anything.
Look at how he leaked the second DNA test results and purposely misled everyone and then waited until 5 on a Friday to fax it to defense.
Perhaps. But ultimately that's how this trial will be decided. The law has been trodden into the dirt in Durham...
