Osbon: We've submitted pretty clear alibi defenses that are airtight and character witnessses from senators, family, friends.

Judge: $400K within the guidelines for this charge. Not going to hear your bond reduction request today since he's out on bond. Has it been filed? Then I'll hear it. I'll review it at the next setting we'll hear you on it.

Osbon: Motion to preserve all hand written notes, memoranda, everything genearted by law enforcement in this case. We want it all preserved so nothing is destroyed.

Judge: I'm trying to think of logistics; if someone is jotting something down on a cardboard box? Are you talking about officer notes that htey keep in line with the process?
Yes? I'll allow that. They will maintain the notes.

Osbon: I understand the custom of the county is to permit us to go through LE files. Custom to permit us to go over to LE agency and go through their files and notes personally.

Judge: I'm not aware of that custom. Maybe that's your take on the custom. You have the discovery process and by statute and whatever else the DA allows is his call. If you find something that you think that you need and he doesn't allow, this court is the place to come to ask for that. I won't sign an order to let you rummage through the LE agency.

Osbon: Will you sign order to require LE to turn over all tape recordings, notes, etc. to the DA?

Judge: No sir. I'll let him proceed as he normally does. If hter's something you think you need, come here. I won't order things that should be done voluntarily.

Osbon: This is a serious case.

Judge: I deal iwth serious cases every day. It's not going to jump ahead of the line of other cases or handled differently.

Judge is allowing Nifong to proceed normally with discovery!!! All the cases in his court are serious.

This is bull.

Defense wants to go to trial as fast as they can so Reade can go to school in the fall.

Judge says there are other cases ahead of this one on the docket.

Nifong says he's turned over everything he has.

Next hearing - the week of the 19th of June.

Osbon: So to get matters heard that week, we need to notify the prosecutor?

Judge: Administrative court so trial issues, not knowing who the trial judge will be, won't rule on those this early in the admin. hearings. Hopefully the trial judge can be involved and if I'm the trial judge, fine, but I don't want to start things in motion for the judge if I'm not.
