Who can initiate the filing ?
John Q Citizen , defense attorneys , fellow prosecutors or the AG ?

I do hope there are calls from both Kim's & Crystal's cell phones to their employer, one from the boy's bathroom and one from the car BEFORE they got to Kroger's.
We know Crystal was "stoned" or "drunk" but Crystal is also a liar. Was she REALLY sleeping or did it look like that to the guard?? We've all "pretended" sleeping at one time or another.
It sounds like Nifong has violated nearly all of those ethics rules and could be removed.
Maybe we should start a petition here on FR and mail it to the Governor?
BTW, yesterday some legal schmuck on FNC said that every state provided for a speedy trial at the request of the defendant.
I've read that NC decided last year not to offer a speedy trial to defendants anymore; do you know anything about that?

Woody Vann, who I consider the greatest lawyer in America due to his managing to turn Crystal's numerous felonies into misdemeanors in 2002, talked about that with Greta.There is NO speedy trial mechanism in NC. Instead, there is a "case management" system with about a gazillion steps what every case MUST go through before trial. That's why a case like this takes on average 20 months to come to trial.
Defense asking for recusal of NiFong??? Interesting! That should raise a red flag with NiFong. It means either get lost or... prepare for battle...and it will cost you your license and possible charges.
Thanks for answering; I turned to my husband and said that freepers have repeatedly said there is no right to a speedy trial in NC and that freepers know more than the supposed legal eagles on television.

I agree, I think it is phone records, a 11:50ish arrival phone call (directions from Dad) and then bathroom phone calls
and also I think in the car she was drunk and perhaps having a panic attack of some sorts, she was grabing the wheel and stick not getting out of the car, and at the club where she stole the cab, she crawled under a table and would not come out, interesting behavior.
I just want to see a call from the bathroom to her employer at 12:15....A 4 minute call.
