It is unclear if or how the first DNA tests missed what appears to be the only foreign genetic material found on the alleged victim's body, defense attorneys said. Two Duke lacrosse players were indicted more than two weeks before the cheek swab was taken from the "boyfriend."

Am I reading this right--the "boyfriend" was NOT swabbed BEFORE the GJ indictment? What the heck??

Well, that tells me one of three things:

1) The CGM told Nifong that she had no boyfriend, or had not had sex with him for X number of days, so he believed the semen to be the "rapists'".

2) This is not a traditional "boyfriend" and they had to track this person down to get a DNA sample from him, AFTER the DNA results came back that it was NOT any of the LAX players.

3) The "boyfriend's" DNA is already registered on the DPD database, and once they entered DNA profile, they had their match. BUT THEY FAILED TO DO THIS BEFORE THE INDICTMENTS.

All of which lead me to conclude that CGM is a liar and Nifong's case is OVER. The defense will tear this to shreds, if Nifong is foolish enough to continue this persecution--er--prosecution.

Here's something to throw into your scenario:

Recall that the first DNA tests came back on a Friday, late in the day, two days before the GJ met on that following Monday at 9 a.m.

You don't suppose he went ahead with the indictments, knowing another man was involved, do you?

Either that, or he got a heads up from LabCorp that there was a ringer out there?

The rape kit used in hospitals contains an information sheet. One of the questions asked of the 'victim' is if she has had consensual sex in the FIVE days prior to the 'rape'.

Seems to me they'd have to testing half the population with this AV.

If this is true Shelayne, this "boyfriend" may have come to the attention of the investigators because they had to track the whereabouts of the A/V in the hours before she went the party. It is HIGHLY doubtful that she told the ANYONE that she had sex with this "boyfriend" before the party. Also, this makes sense that she did have sex with someone before the party, and it would tend to back up the SANE report. If she had sex, and if she had some scrapes and bruises, would it not be consistent with "rape trauma?" The SANE report would be consistent, but it hurts her story (what doesn't?) if she claimed that she hadn't had sex for two weeks.

IIRC, early reports stated that Mangum told the medical staff conducting the rape exam that she had not had sex for three weeks, then later I read that she said five days.
