May 13, 2006 The second round of DNA test results in the Duke University rape investigation show "no conclusive match'' to any lacrosse players, defense attorneys said, but a vaginal swab of the alleged rape victim produced DNA from a "single male source'' a man not on the lacrosse team who did not attend a March 13 party that was the site of the alleged rape.

Defense attorney Joe Chesire declined to identify the mystery man or his connection to the alleged victim, but ABC News' Law and Justice Unit has learned that the unnamed source of the DNA is the alleged victim's "boyfriend," according to her mother.
ABC News is withholding the name of the man because he is apparently not a target of the investigation. Records indicate that Durham, N.C., police gave the "boyfriend'' a cheek swab to collect DNA on May 3, ABC News' Law and Justice Unit has learned exclusively.
It is unclear if or how the first DNA tests missed what appears to be the only foreign genetic material found on the alleged victim's body, defense attorneys said. Two Duke lacrosse players were indicted more than two weeks before the cheek swab was taken from the "boyfriend."
It is also unclear whether the alleged victim had sex with the "boyfriend" the night she claims to have been raped by three Duke lacrosse players. DNA experts tell ABC News that genetic traces of semen can remain in the body up to six days after intercouse.

The hornets are stirred up against Duke -- Nifong`s just a boy with stones throwing them at the hornets` nest. He may go, the trial not happen, but the hornets are still there. It is Duke`s future on the line, and what are they doing about it?
What I'd like to know is: How many different semen sources did they find on the FA? I don't think that question has been addressed.
Swelling is indicative of a "very recent, long sex session" not 4-2 minute sessions with a smooth condom besides. Swelling would be diminished with just a shower and likely not observable after 24 hours.
Crystal is an active 27 year old...not exactly a virgin.
They (Duke U.) need to shoulder their burdern and do so quickly and assuredly. To support the students is primary -- in the trial and in life, that is by setting and making stick higher expecations of behaviour and mutual concern from both the University and the student body. The University MUST support the team, the boys the athletes and students sucked into this vortex of prosecutorial proceedings. That is simple LOYALTY and DUTY.
I'm meaning honest support -- you don't support a student doing a crime, you support the student, YOUR student. As a teacher, as a educational institution there are ways of showing sauch support that avoid, and should avoid, the direct issues of the crime.
And then Duke has to bridge -- not pander, not roll-over -- to the black community in a firm way, a way that shows a promise of better relations and involvement of the University and the student body in and with the Durham community. The community, the community of which the black community is a significant and included part.
No more late phone calls "reaching out", that's one. Daytime relations. Year-round, strong, inclusive.
The ball, and the boy's fate, and it's own fate are really in the hands of Duke's higher adminstrators and trustees. They need to act with some dispatch. IMO.

Do we have any idea who the judge might be that accepts or denies this case? Who they get will really matter.
Pre-arrest: Would that be where the boys went in and talked to the cops without their attorneys present?? (Miranda Rights Issue).
