Most likely someone with a record. I do not know if NC has a statewide database? If so, it is possible that, when the DNA did not match any of the LAX players, it was run through a database for a match.
It was brillant of Cheshire and Smith to have a press conference tonight. So much for the weekend news cycle favoring Nifong eventhough he tried to leak and spin, its not working.

RALEIGH, N.C. -- A second round of DNA testing in the Duke University lacrosse rape case showed no conclusive match to any member of the team, defense attorneys said Friday.
Attorney Joseph Cheshire, who represents a team captain who has not been charged, said the tests showed genetic material from a "single male source" was found on a vaginal swab taken from the accuser, but that material did not match any of the players.
"In other words, it appears this woman had sex with a male," Cheshire said. "It also appears with certainty it wasn't a Duke lacrosse player."
We thought that because in the first defense DNA press conference they stated that the report indicated there was no DNA in or on her body from anyone to indicate any sex had taken place, period....
And now those uptight freepers who were waiting for all the facts to come in HAVE THEM NOW, so where are they tonight?
