First DNA link possible in lacrosse case

DURHAM -- Tissue found under the fingernail of an exotic dancer who claimed she was raped at a Duke University lacrosse party may match a player who was there, several well-placed sources said Wednesday.

Analyzing the tissue, scientists concluded it came from the same genetic pool and was "consistent" with the bodily makeup of one of 46 lacrosse players who gave DNA samples for testing, the sources said.

At the same time, scientists ruled out a possible match with any of the other 45 students, according to the sources.

If accurate, the fingernail tissue match would offer the first DNA evidence potentially linking the dancer and an alleged attacker.

But because a complete DNA pattern was not obtained from the tissue, it was not possible to match it with the nearly 100 percent certainty that DNA results usually offer, the sources added.

The dancer told police she clawed at three attackers as they raped and sodomized her for 30 minutes during the March 13-14 lacrosse house party at 610 N. Buchanan Blvd.

Why don't they put the black female lawyer named Georgia and Wendy Murphy and ask them how they feel after they've been spreadin the broomstick assualt rumor as fact.

Georgia even stated she spent a lot of time with the family (of the AV) and that the AV is RECOVERING from a brutual broomstick assualt.

Is there ANY accountability?

Abrams knows who the 90% player is because he was given the transcript to the line-up of the players. WRAL has redacted the names (except for Seligmann and Finnerty) but I would imagine Abrams has the full 89-page motion without redactions.

Probably so. The question still remains when was it activated and why wasn't it served until now if it's been active all along? There's obviously a due diligence requirement or there would be no statute tolling, so why was the warrant inactive, or in abeyance, or NOT stale-dated since it wasn't served?

I believe the three that lived at Buchanan are Matt Zash, Dan Flannery, and Dave Evans.

If many misdemeanor warrants aren't served in Durham, then there'd be all the more reason to have some software built in that kicks the warrant out of the system when it expires unless there is court or statutory authority for the warrant to be valid beyond its expiration date.

Does NC or the City or County of Durham - anybody? - require cabbies to have current permits and go through a brief background check periodically?

This whole thing - the entire case - is absolutely stunning to me that this is even happening in this day and age. I just don't get it at all. The warrant system, the GJ system, no probable cause hearings, no speedy trial, nothing. Call me naive, but I had no idea there were criminal justice systems such as this going on in this country. It's no wonder Barry Sheck and those guys started that Innocence Project. I am just stunned and amazed. This crap woould last about five minutes out here, yet all the lawyers involved in this case seem to just accept it as normal.

Kerry Sutton has already said that two of the captains who lived at Buchanan - Dan Flannery and Matt Zach - were cleared by Nifong. If it's someone who lives at the house who's going to be arrested, it would have to be Dave Evans.

The reason why I'm asking is that he admitted using a fake name and I'd think that'd be enough for Nifong to go after him hard.

Two Duke Lacrosse Players Arrested

"Sutton said Nifong, in meetings with lawyers, had specifically cleared her client, Matt Zash, and co-captains Dan Flannery and Bret Thompson, along with a few others. Nifong declined any comment Tuesday except in a written statement."
