DURHAM, N.C. - Duke underestimated the rape allegations against members of the lacrosse team in part because Durham police initially said the accuser “kept changing her story and was not credible,” according to a university report issued Monday.

The day after the March 13 team party where a 27-year-old black woman claimed she was raped, Durham police told campus officers that “this will blow over,” the report said. It said that the woman initially told police she was raped by 20 white men, then said she was attacked by three.

I thought he didn't have a runoff, that Nifong's plurality took that primary race.

I think you are correct, I believe a runoff is only required if the lead voter has less than 40%.

If no physical evidence can be tied to the accused and this becomes a he said - she said, this fact will be weighed heavily by the jury.

Anyone willing to speculate that DA Nifong is a Durham Townie who has a life-long animus towards the rich kids at Duke?

Probably lost a few girlfriends to "lacrosse" types driving BMWs.

There is no runoff. Nifong got more than 40% in the primary. There is a general election in the fall. Durham is so heavily Dem that the Reps didn't bother to run a candidate. In theory, there could be a third party or write in challenge but that seems unlikely. Nifong's got it for four years.

Mike Nifong's parents went to Duke. He had to settle for UNC-Chapel Hill. Even after all these years later those rejection letters from Duke still sting.

What's it going to take before the DA sees that the stripper Crystal Magnum is lying, lying, lying. It's time to stop dragging these kids threw the mud. And as to the Stripper's Father saying there was a broom stick involved, how convenient. And if it was a broom stick, why all the DNA testing. Shame on Naphong!

Does that kid even shave yet? He looks like a freshman in HS : (

In a just world, this would not have gone on this far. Since this is not a just world, this means that the strippers won't be prosecuted for filing a false police report, or perjury.

To: When do we get liberated?
Just one more run off and he wins. His voter base (lets just say they are likely Democrats) appreciates the way he has pursued this case.

Hammer. Nail. Right on the head.

You hit it. Way before this case is ever ready for trial, the "accuser" will crawl back under the baseboards like the cockroach she is. Then Nifong can say "She just couldn't bear to go forward", and the whole thing will be dropped. I hope he gets his a$$ sued off, but I doubt it will happen.

The real belly laugh here, however, is the Duke "report" which basically says this: "Although the allegations are incredible on their face and no sane person could believe them, we forgot this was a 'Black Victim of over-privileged White college boys case', so we should have taken it very seriously. We were blinded by the University's 'lack of diversity of life-experiences.' We are so ashamed."

The case may have been handled better “if a wide array of life histories and perspectives had been brought to bear..."

Yup, they've put their finger on the problem -- Duke administrators obviously need to spend more time with prostitutes, strippers, pimps, car thieves, drunk drivers and embezzlers.

That doesn't surprise me. Everything about Nifong says "loser." He's been at his job 27 years, I believe. He was handling traffic tickets a few months ago, and I'm sure he was best suited for that role.

This case is a dream come true for him. He'll be riding this case to "media contributor" on the news channels within a year or two. Look at Darden and Clark from OJ. Two sorrier lawyers you'll never find - maybe the only two who could have lost the OJ case - but they're still on TV as consultants.

When we piece together all the changing aspects of her story, it's really quite shocking the lengths to which this DA went to in order to get those two players arrested. Ruined live and for what? A mentally unbalanced stripper whose timeline and story and previous history of such accusations don't stand the laugh test.

he said that the defense had exculpatory evidence on the defendants and that Nifong wouldn't even look at it.

It's the truth. We here on FR had our jaws dropped onto the keyboards when this happened. Nifong refused to look at the evidence.

For those of you who may be just joining us, here is some background on Nifong.

In between UNC undergrad and UNC law school, Nifong was a social worker. When he got out of UNC law school he couldn't get a job so he volunteered in the Durham DA's office where a short time later he was made an Assistant DA. During that time he did try some big time cases. In 1994 he was made Chief Assistant DA which is more of an administrative position. Five years later he got prostate cancer and took off a year to deal with that. When he came back he was put in traffic court. He was there until about a year ago when then Durham DA Hardin was made a judge and Gov. Easley appointed Nifong as DA. First thing Nifong did was to fire his main competitor in the DA's office, Freda Black. Nifong jumped on this case precisely to use it as a vehicle to win his first election. His main opposition was Freda Black. He was successful and now Durham is stuck with him. In their eyes, his main merit seems to be that he'll break whatever rules are necessary to gain a conviction.

When the Lacrosse coach resigned, did he make a statement? I'm wondering if he wanted to speak on behalf of his players but was prohibited from doing so. Anyone know?

This leak is damage control for the prosecutor.

He blundered big time when he showed the alleged victim a photo array of all the lacrosse players and did not include any independent photos.

He can now claim that the reason he did this is because the alleged victim indicated a much larger number were involved and not just the two accused.

I suspected there was something like that was in the mix.

The election notwithstanding, Nifong is way too aggressive in this matter.

My own take was closer to Swamp Fox's.
