Report: PD Said Accuser Was Not Credible

It said key administrators relied too heavily on initial reports from Durham police that the alleged victim "kept changing her story and was not credible."

It didn't surprise me that a very PC school like Duke would produce a committee report like this. An outsized concern about the "racial aspects" of the case and worry if a lack of diversity in the administration contributed to a failure to act sooner are par for the course there.

What interested me in the report was what very well may enable the players/families to sue Duke for damages:

"The players may been been lulled into a false sense of security about the events shortly to unfold and might well have sought legal counsel sooner had they been aware of the stakes. Some parents of the lacrosse players were (AND ARE) distressed by the failure of Duke authorities to alert the students and their families to the seriousness of the situation in the days immediately following the party."

Would the three team captains have participated in 25 hrs. of police interrogations on March 16 if they had had lawyers at the time? Not likely.

One of those captains, David Evans, apparently admitted to being at the party where alcohol was potentially available to underage players. For that honesty, he is now faced with a criminal record, as Nifong has rescinded his earlier misdemeanor diversion deal.

If I were his, or any other player's parent, I would be eager to punish the Duke administration, as their failure to advise me or my son as soon as this case came to their attention (Mar. 14) resulted in grave harm.

Just because the people on this committee have Ph.D.'s doesn't mean they have any common sense. Yet somehow they think they know so much they can make these pronouncements. LOL

My favorite: The president should have been told the AV was black. Really? Based on her race he would have made different decisions?

Duke should start giving back all their federal money if that is the way the school is run.

You know that's something I can't figure out. Is the implication that the Duke admin was supposed to have been thinking that the rape was of a white woman, but hey, no big deal?

Just when I think this case could not get any worse for the prosecutor, then I read that police officers don't believe the accuser's changing story.

Unless Nifong can find a jury made up of 12 escort workers, he will have a hard time convicting anyone.

"The Durham Police District 2 Criminal Investigations Violent Crimes Unit is conducting an investigation concerning a rape of a young woman by three males at 610 N. Buchanan that was reported on 3/14/06 in the early morning hours. The female arrived at the residence for a party close to 11:30pm on Monday 3/13/2006 and left on Tuesday 3/14/2006 reportedly after midnight. ..."

That pretty much sums up my opinion of Duke. There is zero diversity of opinion among the administration, so they always do the PC liberal thing. I have a hard time believing I stayed at that place 11 years.

As a prosecutor, I have to say that if there is not more - some hidden witness or physical evidence - there is not a triable case. This is an excellent illustration of the difference between probable cause and proof beyond a reasonable doubt.

Why were they investigating 3 males since she said that 20 males raped her? And that timeline doesn't comport with the neighbor's statement or the player's photos.

If this officer is making out this report at 1:22, just minutes after another officer said the AV was passed out drunk, who could possibly be giving her the information?

And if the AV was "drugged" as Kim would have us believe, how could she remember what type of cell phone she had and how much money was stolen?

And notice how drugs was indicated as N/A....

Some of this information we're getting just don't jibe... or would that be jive?
