Duke lacrosse case may not come to trial until next spring

DURHAM, N.C. - Mike Nifong emerged from his first campaign for public office with a victory and a confident smile, saying he was eager to get back to running the district attorney's office.

He also spent plenty of time during the campaign shunning questions from reporters about the rape investigation against two members of the Duke University men's lacrosse team.

It's a task he'll have to get used to considering the long road ahead.

Nifong said he doesn't expect the case to come to trial before next spring, setting up an intense and lengthy standoff between sides that have refused to budge

Maybe but, a year from now, few people will care and certainly not enough to get him tossed from office. That's what I think his strategy is.

So a few reputations are sullied forever. That's not his problem.

This is an attempt to get the athletes to plead to some minor offense to get the case behind them.

Ni-FOG will then declare victory.

I hope the boys never cave in to this ugly blackmail.

LOL....daughter lives in CO. It's always everyone's base. When you live in a vacation destination it's the way it goes!!!

First of all, thanks for the NEW THREAD PING.

Nifong does not have a case against the two indicted. I do not think he will move forward, and if he does he will not get a conviction, regardless of who wants heads on a stick.
This case will be moved from Durham, because judges do not like to be reversed on appeal, and leaving a trial in Durham would certainly be appealed if there was a conviction.
Heck, if a judge refuses a COV I think the defense might be able to appeal that ruling immediately, even before the trial starts.

I am confident that a COV will be granted.

Meanwhile, those young men will be under a cloud next year while pursuing their studies and while Nifong dithers, looking for a 3rd one to indict.

I wonder if Crystal and Kim will keep their lucrative night jobs. Or will the multiple escort services be laying off workers because of decreased business?

Well part of it may mean that CF and RS will continued to be suspended from Duke for both the fall and spring semesters. This means they will have lost three semesters.

An orphan now, Borden has been appointed a guardian and is represented by legal counsel. A court affadavit released on November 22, 2005 negated a charge of kidnapping against David G. Ludwig, and concluded that Borden fled with Ludwig of her "own free will". Ludwig's lawyer has reportedly stated that Borden willingly accompanied Ludwig in their three-state flight, and surveillance tapes indicate Borden had ample opportunity to escape. Borden has admitted she ran after Ludwig as he left her home; Borden claims she wanted to marry Ludwig. Borden's situation is similar to that of Caril Ann Fugate, the 13 year old girlfriend of Charles Starkweather.

Kara Beth is regarded as a victim, and no charges will be brought against her by the Lancaster County DA, based on statements made by her and Ludwig during the investigation, and also based on the evidence collected, including emails, blogs and text messages.

That makes me sick to my stomach....At the very least, considering the exculpatory evidence out there, they should have been allowed to take the exams.

Was this an unintended consequence of the rush to indict or is Nifong that snarly?
