Duke lacrosse case may not come to trial until next spring

DURHAM, N.C. - Mike Nifong emerged from his first campaign for public office with a victory and a confident smile, saying he was eager to get back to running the district attorney's office.
He also spent plenty of time during the campaign shunning questions from reporters about the rape investigation against two members of the Duke University men's lacrosse team.
It's a task he'll have to get used to considering the long road ahead.
Nifong said he doesn't expect the case to come to trial before next spring, setting up an intense and lengthy standoff between sides that have refused to budge

Maybe but, a year from now, few people will care and certainly not enough to get him tossed from office. That's what I think his strategy is.
So a few reputations are sullied forever. That's not his problem.

Ni-FOG will then declare victory.

First of all, thanks for the NEW THREAD PING.
Nifong does not have a case against the two indicted. I do not think he will move forward, and if he does he will not get a conviction, regardless of who wants heads on a stick.
This case will be moved from Durham, because judges do not like to be reversed on appeal, and leaving a trial in Durham would certainly be appealed if there was a conviction.
Heck, if a judge refuses a COV I think the defense might be able to appeal that ruling immediately, even before the trial starts.
I am confident that a COV will be granted.

Meanwhile, those young men will be under a cloud next year while pursuing their studies and while Nifong dithers, looking for a 3rd one to indict.
