Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

Ok. You're the second person to call me on this one. I did see her on O'R today and she was obviously not giving in even tho all the evidence to this point shows she should have no further justification to support this woman.
Yes, Wendy Murphy did sound idiotic. I don't know how she can continue to stand up for this woman. I wonder how she's gonna handle it when the case is dropped. She'll probably say it was a travesty of justice, or no justice was done, or some other bull like that.

BOR went to the high school of the elite on Long Island. None other than Chaminade...Alma mater of Collin Finnerty. Something tells me you won't hear BOR mention that.
I haven't watched O'Reilly on this subject until today i think. Do you think that from the beginning he's been biased in favor of the accused?

When i was in the Army, Nifong's little fiasco would have been called a 'Charlie Foxtrot from the get-go'.

Nifong has been playing fast and loose. He's had those tox reports for awhile, even if he says he doesn't. If there was a date-rape drug in her system, he'd have charged them. There's something very fishy about all of Nifong's moves. I think he's covering up his lack of evidence but intimating that he actually has some. The other possibility is that she wouldn't give consent for tox and BAC tests.
Rest assured they are working in close concert. Reade's attorney should be taking the lead because information about his alibi is already out to the public. There are pictures to show and other forms of evidence. That will help carry the case for Collin's innocence, too. Remember, Collin also has the D.C. matter hanging over him. As a matter of public perception, it's better for the case that Collin stays in the background and they let the strong case for Reade's innocence lead the way.
They were trespassing. If I'd been the guys who live there (I realize they are quartered elsewhere at the moment), I'd have figured the race-baiters would be coming over there. The minute they stpped on my property, I'd have called the cops and told them there were some weird looking people in my yard creating a disturbance. Then I'd have videotaped the cops running them off the property and turned the video over to the defense to use as part of their motiton for change of venue presentation.
The defense attorneys need to subpoena the department of Social Services and Child Protective Agencies for complaints about her treatment of her kids. If she was on the brink of losing them, it will be in the records. It would certainly be a motive to change a drunk in public of a positive tox result case to a rape charge that puts her in the driver's seat.

Does Durham County have a clean elections bureau? Semi-clean?

I am more curious why the governor would appoint Nifong.
I guess Nifong was good at making connections in that traffic court.

Yes, this is true.
That's why I'm worried about the DNA tests and the dorm search warrants. I am not a conspiracy theorist, and I'm not one to condemn LE, having been an active part of it for over thirty years, but I think Nifong is unhinged and thinks he has carte blanche to do anything he wants to do. His conduct in this case has been so far outside the normal behavior of a dedicated, ethical, professional prosecutor that I really am concerned that some DNA evidence has been planted.

I do not know, I assume they close around 8pm like most elections.
I think some of the local freepers will give us updates tomorrow evening.
