Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

Thanks for the link. I had read some of it before. Clearly there are parts of that missing as only one of the indicted are IDed.
But concerning my conjecture, she did ID the first 90%. The transcript does not mention anything, but clearly she got no verbal cues that 90% was not good enough. That makes the IDs even more suspect.
I think you hit the nail on the head. Black would have outshined him greatly.

Nifong would have to defeat the time stamps in order to move the arrival and rape back to between 11:30 and 12:00, and then he has Kim's call at 12:53 to contend with, too, as well as Bissey. There're too many obstacles. I say Bifong is bluffing, and that's why he keeps using hypotheticals with the media. He won't commit to these strong implications because he can't deliver. He's just placating the media to keep them off his back.
You are correct. Possible, but extremely rare.
But in Nifong's case, the need for his testimony could go beyond just the ID.
I remain dumbfounded that NC has no other probable cause venue prior to trial.

I know that Nifong won the Democratic primary a couple of weeks ago, winning with 45% of the vote. Freda Black came in second with 42% of the vote. I know at the present time, there is no opposition on the Republican side running against Nifong. So unless the Republicans put up a candidate to run against Nifong, then he has will almost definitely will be reelected as Durham County DA.
I read where another candidate can run against Nifong and have their name included on the ballot, if they file by the end on June, as a Republican?
I would like to suggest that the Republicans get together and recruit Freda Black to run again against Nifong. Black pulled in a very good percentage of the Democrats in the primary. If Black would choose to run as a Republican, and she kept a good percentage of those who supported her in the primary, and in addition, she were to capture a sizable majority of the Republican voters, then maybe we would see Nifong defeated at the polls in November.
I would also think she would receive a lot of campaign contributions for her campaign from the many people who are disgusted with the way this DA has handled this case.
If not Freda, then please, I call on the Durham County Republicans to put up another candidate?
