Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
There has been a rare sighting of one of the world's rarest mammals - the Durham Police Chief:

Those wondering about his hints that he has something else are left with the following choice:
A. Either has something else and his side has not leaked it and he enjoys looking like an idiot and having people like Stuart Taylor write columns about what a bad DA he is.
B. He does not have anything else other than the hope that further DNA testing will match inconclusive samples to someone he happened to indict.
Which one make the most sense given Nifong's prior behavior with evidence?

Apparently, that scenario was considered plausible on the Crier Report the other day.
Gloria Allred's daughter was hosting and said that we all knew Bill Clinton could talk on the phone while Monica was servicing him, so it wasn't out of the question that Seligman could do the same.
The difference in the two situations was lost on her and the rest of the Lady Airheads on the panel.
Yes, especially since such information would have been helpful to his election-- unless he just happened to get them the day after the election. I go with the blowing smoke theory.

Kimberly Guillfoyle (on H&C last night) was dumbfounded at the DA's statement that the trial might not be until spring 2007. She said that was highly unusual in cases such as this. Usually the prosecution pushes for a speedy trial in rape cases, and it's the defense that wants to delay, according to her.
Nifong probably wants to wait until all the public furor has died down and this case has been put onto a back burner in people's minds. Then he can safely announce that the AV has decided not to press charges, since she can't stand to live through that horrible night again.
Meanwhile, the accused have to live through hell for another few months...
That makes sense but the goofy guy keeps stocking the fire. I think he likes the attention.
