Yes, especially since such information would have been helpful to his election-- unless he just happened to get them the day after the election. I go with the blowing smoke theory.

Also, wouldn't a third arrest have taken place if there was conclusive DNA?
I think blowing smoke is more up Nifong's alley considering his chest pounding at the beginning of this case.
He won and election after being totally incompetent, so he figures he can say anything and nobody will hold him to it.
