Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
The D.A. brought this on himself. He was the idiot that brought it out to the public.
How can he possibly know any results if the test results won't be ready until 5/15? I wonder if Nifong gave the family a pep talk, and they spun it into this statement? So far as I've seen, the family is a pack of liars, period.
Just tell the NCCU students their school is just as good. They'll believe it. They seem to believe most anything they're told to believe. They're easily convinced.
I really don't see it being huge, if there was hair found in her pubic region.
She was in the bathroom - naked or half-naked. There are pictures of her laying on the floor half-naked. I also
understand at some point she was laying face down on the floor while Kim was dancing.
So, you have a filthy (defacto) frat house and the woman entered barely clothed. She, ostensibly used the bathroom at some point. She laid on the floor in unusual postions also.
Semen found on her or her clothes - that's BIG. A hair? Hairs can be aquired through normal transfers... And throw the statistics out unless the stats are of drunk strippers laying on the living floor in multiple positions.
I believe they have a hair or hairs. I don't think that means anything to people educated in this area.
Now, did the hair come from a toilet seat? Did it come from a baggie in an investigator's pocket?
Someone said they pull 50 pubic hairs from each suspect, or in some jurisdictions that's how DNA Hair samples are taken from potential suspects.
Many times the DA gets preliminary results from the labs.

That's why NIFONG backed off the first DNA tests what 10 days before they came back; he was notified of the Preliminary results (IMO). NIFONG was DNA-DNA-DNA, we have the DNA in interviews.. Then he was the DNA doesn't mean anything. I will proceed without DNA, it doesn't have any bearing on this case, and then NIFONG said he would not release the results of any DNA tests. Caller after Caller on the morning talk show picked up on his abrupt change and then started predicting there would be no DNA match (from her internal swabs). Later, the results came back as Nifong words and actions had foretold.
It doesn't matter if she picked up a hair belonging to one or more of the team captains because none of them are whom she identified from the photo line-up. The thing to worry about is the search of Collin's and Reade's dorm rooms. Presumably the lab already had all samples before that, but I am champing at the bit to examine the chain of custody of the DNA samples and the rape kit swabs and combings.
I think he's bluffing.
Megan Kendall said the defense attorneys don't seem to know what is being tested. Nifong won't tell them.
Howlin knows somebody at the lab #2 and supposedly it's not a hair - it's a more refined re-test of the same samples.

The other players frequently spent the night at that Frat-house, so it wouldn't be just the DNA of the captains.
Early on the investigation when the reported the neighbor's complaints of noise, partying, urination... etc one said they have way too many people in that house - it violates some rule. Speculation was that the players sleeping over a lot made it seem like there was many players living there. 3 were on the lease, but 610 Buchanan was the hang out for the team.
Maybe Nifong intends to spin the inconclusivity of the four separate DNA profiles found under the fingernails as tacit proof of more than one attacker supporting Manum's story.
I think Megan said the family said that Nifong said there MIGHT be good news on the way concerning the DNA. That's a true statement, whether he has a clue or not.

In order for Nifong to have "good" DNA results, it would have to be a match with Reade and/or Collin. The die is cast, given the 100% positive ID on Reade and Collin. Picking up a pubic hair or any hair from someone who lives in the house is meaningless. Even a foreign pubic hair combed from Mangum's pubic area won't help Nifong unless it's from Reade or Collin.
It wouldn't make a lot of sense for Nifong to go passing this information that there was good news on the DNA, if it wasn't TRUE. To a degree - NIFONG interprets it as positive for the prosecution. Nifong also conveyed that there are things in the DNA report that the Defense doesn't want out there (from the first testing).
Nifong would lose face with Geraldo, Newsweek, N&O, and other supporters if he led them to believe we have good news and then it turned to not be the case.
Okay. But I doubt they showered there. Get drunk, pass out, go back to the dorm the next morning, shower, eat, go about the day's business. So, even if they hung out there, how likely is it that one pubic hair from Reade or Collin was there, and how likely is it that that one in a million chance pubic hair wound up in a pubic comb of Mangum's pubic area?
Yes, I heard her say that, but she wasn't positive about it at all. That rumor has been out there awhile, and it came from the speculation of TV lawyers. i heard one time and one time only that pubic hair samples were taken from the players, but there's nothing about taking a pubic hair sample in the NTO for the DNA dragnet, unless I missed it. I will go check again.
Yes, you are probably right.
I saw a show where a forensics guy - maybe Baden or Kobe (Kobilinsky - John Jay College) detailed typically how samples are taken from suspects in rape cases. I was surprised they took 50 pubic hairs (seemed like a lot), but that's what he said.. It was a GENERIC statement and did not necessarily apply to NC.
It sounds like a Nancy Grace Question and that would've made the expert Kobilinsky.
