Duke Rape Case Defense: Throw Out DA Nifong and Photo ID
ABC ^ | May 1, 2006 | CHRIS CUOMO, ERIC AVRAM, and LARA SETRAKIAN

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

"There's a definitely a feeling in the Duke community that N.C. Central is the lesser institution, and I've heard Duke students make that statement," said Howard Clement, a Durham councilman for 23 years. "I don't think that's something we should ignore."

If Duke and NC Central are equal institutions NC Central students should be pleased they pay much less tuition.

I do understand, LB. I concur/agree fully with you that males at colleges need to be MORE than careful; lest they be verbally "lynched" at any and every college campus.

And I didn't mean to throw stones at the boycott; I've seen how such a boycott plays out, unfortunately. Decent females end up "going along" with feminist ant-male rant. "They are unhelpful, inconsiderate, self-centered slobs."

And you are quite right to suggest and counsel: "Well I meant no walks home through the scary parts of town, no changing tires, no heavy lifting, no giving anyone rides, etc. [my insert: WITHOUT FAIR WITNESSES OR MEANS PRESENT].

One of the most useful gadgets I was presented with in the 90s was the voice activated recorder. Just sooo handy.

Aren't the ages of the children around 7 and 5?

The following is what is reported in the media: Mother, dancer, accuser

She began active duty in the summer of 1997 and was sent to school in Dam Neck, Va., near Virginia Beach, to train for her job operating radios and navigation equipment. That fall, the couple got married in Virginia Beach. The union would allow the woman's husband to travel wherever the woman was stationed, he said. The former husband said he was illiterate when he married the then-19-year-old woman. She taught him to read, he said, and was kind and patient during the process. After months of tutoring and many evenings spent paging through beginning-level books, he said, he was finally able to fill out his own job applications."She never downed me for that," he said. "She loved me for who I was." He said he saw her after the accusations of rape were reported and she appeared distressed. As newlyweds, the couple moved to Concord, Calif., where the woman was assigned to the USS Mount Hood, an ammunition ship.

She was often away at sea for days or weeks, and tensions flared in the marriage, her former husband said."She was young," he said.Along the way, the woman became interested in another sailor, a man who would later father her children, the former husband said. The two separated as the new relationship began, he said. Six months later, she was discharged from the service.A U.S. Navy spokesman would not release the reason for the discharge, though records indicate it came less than nine months before she had her first child, a boy, named after his father.Court records show the divorce became final after she gave birth. She continued her relationship with the sailor, and the two had a second child. Soon after, the couple parted ways. In 2003, the children's father was ordered by a Durham court to have a portion of his

Who told Megan this? Not the father because he is loopy.
Also, did Megan say the DNA was a possible hair?

I think this b@stard has had a heads up from the lab.

I do not TRUST this hair.
Where was it located on her?
She was IN the house after all, rolling on the floor for her "dance", in the bathroom where the team captains shower.

Thanks. Did Megan say when Nifong called and told Mangum this?
I know Nifong mentioned on Rita, or Greta I think, that he talked to her and told her to hang on. I wonder if this is when he mentioned the "good news" coming from the DNA.
If I am not mistaken, he said this to Mangum BEFORE the election.
If that's the case, I say he was keeping her from dropping out before the election and making him look bad.

I do not trust the man.

And the father of the alleged victim in this case speaks out in his first national television interview. He does not want his face to be shown in order to protect the identity of his daughter. He told me what she says happened the night she was allegedly raped. And some big news. For the first time, we’re learning that the woman, his daughter, says she was able to immediately identify three boys in photos supplied by authorities.

(BEGIN VIDEOTAPE)

UNIDENTIFIED MALE: She’s a well-spoken girl. And she’d take care of her kids. She’d go to school. She’s just a good child. I mean, she’s my baby girl.

COSBY: She’s a mother?

UNIDENTIFIED MALE: Yes, she’s a mother, too.

COSBY: How old are the children?

UNIDENTIFIED MALE: They’re 5 and 7.

+++++++

It would not shock me if she had a hair or something on her.
I would be HIGHLY suspect of any other kind of DNA.

I just wish a defense attorney would do a small interview with Dan, and let us know WHAT is being tested. Even if they do not go on camera. Dan can just repeat what was said, with their permission.

I did hear the female lawyer for one of the captains was on TV a couple weeks ago saying she does not think there will be any big news coming from the new DNA tests.

we will see

If it's a hair....it better have been found in an unmentionable place.....cause it's not gonna fly if they found it anywhere else since she was all over the house and on the floor......didn't they remove rugs with the search warrants?....I wonder if they were bathroom rugs..
