Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
There is another rape allegation at Duke:

This time the N&O points out they are not naming the suspect because no charges have been brought. Why was that sensible policy not in place on April 2, when they printed the names and faces of the entire lacrosse team? I'm still hoping the families can/will sue over that outrageous editorial decision in the midst of actual lynch mobs.
Tks maggief, do you have a link?
The good rabbi's article is silly for the US. May Oxford and the UK are different, but here woman are the majority and a growing majority in college.
The issue in the US which can plainly be seen from this case is that US colleges are hostile to males including male students.
And if they weren't so skanky, Dick wouldn't be, well you get the picture.
(Good Lord, now I am remembering that hilarious VP thread last year, LOL!)
I'd love to know the relationship Nifong has with the SBI lab. How did he get them to claim the tests were too complex for them to do? How difficult is DNA testing? I wonder if the defense can retest the DNA to determine the race of the person.
Never mind I found it. There are three siblings. One is not named at the site where Marella is mentioned unless there are 2 Marys.
I agree, which is why I think there is something almost pathological about Nifong. He seems to see himself as heroic, and opponents as evil. His "as long as I'm here this case is not going away" tells me he sees himself as indispensible and expects others will see him that way too.
His public boasting of himself as "by far the best candidate" and "I'd be afraid to try a case against me too" type statements are more than odd, they're scary. Adding to the "creepyiness" is his grinning, confident persona.
I don't think that matters. Reade was long gone by then, and Finnerty wasn't there, either, so any hair that may have fallen onto Mangum's clothing or body would have been from some other guy. She's already made her "100%" certain identification, so that dog ain't gonna hunt.
I hope the defense acquires a copy of that video or statement - whatever form it was made in.
Must be the culture of Duke...Shut down the school.
Yep. Not a clue. No street smarts. These guys have been fed the lefty multicultural drivel for so long, they actually believed all races practice the Golden Rule.

_________
Agreed.
He is creepy.
The only explanation that can make both sets of Nifong's statements true is if DNA evidence has been planted. Remember those search warrants of Reade's and Collin;s dorm rooms after they were arrested?
I'm not one to indulge in conspiracies of frame-ups by the police, having worked in LE for thirty-two years, but I have to say that, in this case, it has become a concern of mine.
Despicable media whores.
I was trying to be facetious.... I realize that the screaming happened outside; I was just being snarky to anyone who might read that statement and think the screaming was coming from the inside of the house. (The problem with this kind of communication is that it's hard to imply voice inflection/attitude/facial expression.)
Does anybody know if the same samples were sent to the second lab for re-analysis or if additional samples were sent? Would it be easy to find hair or something in a dorm room and put it in the mix for a second analysis?
A larger, brighter copy of that photo is available (somewhere), but the peeled paint revealing the light promer on the roof and the side of the car is still visible even in this copy. I wonder if Kim's car has more of this on the hood and/or fenders such that the cabby perceived the car as being white?
I hope the defense gets full photos of Kim's car.
Bless me, if I didn't just raise some immediate ire and hackles. groan.
It gave me the sense that she was projecting what was actually her own plot back onto Mangum.
No matter how many times and ways I try to make sense of this situation, Kim's right in the thick of it. So, yes, I'm with you on Kim's "projection".
But I have these other curious side-issues which continue to raise my alarms. Some might call them "conspiracy" theories, but they aren't. These are based on my actual, first-hand knowledge of certain groups and behaviors.
For one. I wanna know WHO all in this fantastic story is involved with an NOI/NBP type of "church". That evangelist, whathisname, came right out of the brand-name cereal box of flavorings for this one. I recall he did his racialist-flavored preaching in front of 610 Buchanan. Plus, my own witness of how NOI etc treat women, view women. Yusuf Bey, involved in the arson of several Oakland, CA booze stores and grand auto theft was just busted at a strip joint trying to run down the bouncer(s). There are some peaceful Muslims in the SF Bay Area; but as "proslytizing" and recruitment for "Islam" began in the CA prisons back in the 80s, I've seen the decrease in "peaceful" and an increase in the "NBPanther" types. and Militant groups have been bullying the peaceful Muslims for years.
How much of Black Durham is involved with this "militant" group?
There seems to be some interesting background to make me wonder if there isn't a militancy involved or running through the Police/City Departments of Durham and Near Durham cities.
I look at it this way... FR search for the key word "Wachovia". Wachovia was being blackmailed into paying reparations. In Chicago. To Chicago. There's more.
I keep my eyes on the particulars of this DukeLax situation; but I know for Nifong ad nauseum to be this blatant, there's a bigger game going on.
It's not just simple "incompetency". And it bugs me.
He and his allies are in everybody's faces, basically asserting: "Yes, we're screwing you. We're screwing the American Criminal Justice System. We're screwing the taxpayers of North Carolina. We're screwing Duke. Whatcha gonna do about it, huh?"
As a headline "communications model" to be "heard around the world".. what, precisely does all this communicate to "others" who hate the American System and way of life.
Thanks for hearing my thoughts.
Back to the case: I'll tell ya whatelse got me, and I haven't had the chance to do some research yet: Did you know that Janet Reno helped open some type of special "forensics testing" think tank in Greensboro? Durham and Greensboro are not too far from each other. And so I think about this "second set of DNA". A lot.
I have such clear distrust that "honor" is the principle in re this case, all it would take is for some old girlfriend to supply a strand of Duke/LAX player hair from an old brush.. and I'm sure you know what the headlines would say: NIFONG VINDICATED!
Yes, the handling of this situation has been that bad. I do not trust at all those going after the players. I do not think these are honorable people.
