Duke Rape Case Defense: Throw Out DA Nifong and Photo ID

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

I do not think the voters who voted for Nifong really care about those white kids either way.

Nifong does not want to hear from them, because they are not saying what he wants them to say,"I did it".

I think he is an incompetent boob.
I am not sure why the idiotic commentators on TV who do not even know this man keep saying, "I am sure he has something up his sleeve."

How do they know. The man is 55 and the only reason he was even in his position in the first place was because his buddy Hardin (who I like) appointed him on the out the door. There is nothing to ead me to think Nifong is some whizzbang lawyer. I guess spending 30 years as a state employee in Durham does not impress me. Sorry!

You don't understand. There's nothing to "see through". Nifong made it clear to his black voter base that he would break every law he needed to in order to convict the two white guys to produce a "feel good" moment for said base.

I don't know. The people that I work and socialize with that live in Durham county and real upset. They fear for the schools and the whole place if people like Nifong continue fanning the flames.

Several have told me they believe Nifong will run for Mayor or some higher office after the trial. He's sure to be a local hero, but many feel like he'll be making things unsafe for their families...., and, of course, no one wants to think they or their families and friends would ever have to face this type of justice.

Seriously, Nifong is breaking a lot of the ethics rules. He's tossed them to the wind in order to be the a Media star. Several prominent Judges and the New York DA always on Greta (Perirot), said they're concerned if the DA has inserted himself into the case to the point where he's telling the investigators how to do the lineup. Mark Furham indicated last night on Hannity & Colmes that this is not how investigations are done. He said the Investigators should handle the lineup and gather the evidence and then it is handed over to Nifong. The investigators have told the N&O that their own rules were violated because Mike Nifong TOLD THEM TO. That is highly unusual to have an investigator even make that comment.

I have several e-mails from friends that have left the area for jobs, etc. that have written to say how happy they were to get out of there (Durham/Durham County).

I have looked and looked searching for rhyme or reason to this.

Surely the quest for power would be trumped by a respect for truth, at least when the future of these kids hang in the balance. (okay, young men, but as a Mom, they are kids)

As cynical as I am, I still have faith in our law enforcement and judical system. I believe the majority of those are people of integrity. But there are bad apples.

There are times it is what it is and maybe looking for a deper, hidden reason is a waste of time.

I mentioned this in a post a couple of days ago.
I think he wants to win this case and become a celebrated hero and thinks he'll be appointed Attorney General, or run for Mayor.
Power is an addiction.
That's why he'll ride this case to the end.

I seriously hope he is disbarred for failure to investigate before indicting. I don't know anything about the law, but there must be some prosecutorial misconduct here somewhere. How does one get indicted by a "victim" who is 100 percent sure it was you, when it's a physical impossibility you were there? Couple that with the 90 percent surety of a third with a mustache, when none on the team was permitted facial hair. I would say there is a great novel in here somewhere, but it's too incredulous.

For a conviction he's counting on a Durham jury behaving in the same manner as the Durham electorate. I can't believe, either, that there is no legal check on his behavior.

From what I have seen of the Durham electorate and what I have read about the crime there I imagine property values are not going to go up much in the near future.

If I lived on that street where the alleged attack occured I'd be very unhappy with the drive-by shootings and demonstrations. Those poor people.

DURHAM, N.C. -- Community leaders are helping Durham residents come together as the Duke lacrosse rape investigation continues.

A woman alleges she was raped by three members of the Duke University lacrosse team at an off-campus party in March. Leaders say the investigation can be a good thing for the community because the allegations are forcing people to talk about things that they have been ignoring for years.

The Rev. William Barber of the NAACP said the first step is to learn from the issues of racism, class and domestic violence that the Duke investigation is forcing people to talk about.

"To face a destructive and dehumanizing reality of these issues and what must be done to prophetically address them and consciously produce change," Barber said.

Leaders said the group will have to face realities that they say have historic roots in pain.

"We can't pretend to be asleep anymore. The issue is in our face front and center," said the Rev. Joe Harvard of First Presbyterian Church.

Leaders said a critical topic in the discussion is the role of the media in the investigation. They claim the media has portrayed the alleged victim as an object instead of a woman and that the community's thirst for a scandal has dehumanized the culture.

"Here is a chance to use that power to try and make this a more wholesome and finer community a better place, because of what you can do and what you can report," said Rabbi John Fredman of the Jewish Forum.

A forum will be held on May 24. Members of the NAACP said this will be the first of many forums to be held both locally and nationally in the next few months. For more information about the forum, you can call (866) 630-3796.
