Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
Was it Jennifer Minnelli? Not sure if the spelling is correct. The lady I'm thinking of was a blond.

I do have some gossip from about town I can share.
Finnerty's DC case began when Finnerty was alone at a bar. A 27 and a 28 year old approched him and called him "gay." Finnerty's friends arrived, and the bartender asked them all to take it outside. The pushing and shoving began outside. (This from a Chaminade grad friendly with Finnerty)
A Duke Lax player anxious to transfer to Georgetown has been told "No. Not until this is settled." (next spring?)
I know these are one sided rumors but they are reliable one sided rumors ;-)

I find something also tacky and crude about Nifong. Interesting to see what all he has in his closet.

GRACE: The Blue Devils! It may not be just a nickname at Duke University, the lacrosse team under fire, one of the most elite athletic teams in the university amidst allegations of gang rape.
Tonight, joining us a very special guest, Jennifer Minnelli, the neighbor of the lacrosse players` house. Well, it`s actually a house where several lacrosse players lived. Welcome, Jennifer. Have you had problems with these guys?
JENNIFER MINNELLI, NEIGHBOR OF HOUSE WHERE ALLEGED RAPE HAPPENED: Yes, we`ve had many problems with them in the past. These students have -- a small subset of students have caused a major public health nuisance within our community.
GRACE: In what way?
MINNELLI: In terms of garbage being left out on the lawn, date rape, alcohol poisoning, driving while intoxicated.
GRACE: Wait, wait! Whoa, whoa, whoa, whoa~! Hold on, Jennifer. Elizabeth, can I ask you -- let`s go to the Liz cam. Could you tell me what their good ranking athletically has to do with rape allegations? Don`t look away! We see you. OK. All right. Go ahead, Jennifer.
MINNELLI: Well, I was just saying that they -- generally, this small group of men have caused a major public health nuisance in our community.
GRACE: Of course, those are allegations. Question to you, Jennifer. Have you ever had to call police on them before?

Even with most people if they're biased or have decided one way - it's very difficult to move them.
Remember, the DA will have experts too (people will be coming out of the woodwork to be involved with this case).
The have confisicated computers from these kids, they are going to find stuff on there. It'll be blown up and out of proportion. They will find people in the kids past to say they used the N word or said this or that. Hell, they may have typed it on their computer.
If Lise Wiehl, Susan Filan, etc, etc. can make excuses for this woman and change the story from the woman's own account to make things fit, I think people that have already heard so much in their own (black) community about the horrors of this case will have no problems selecting the theory that is less likely to have occured.
There was a woman neighbor who is also a witness to "screaming," etc., correct?
That woman gave an interview the very next night and her list was pared down. She didn't say date rape for sure the next night.
I'm thinking someone may have notified her of the slander provisions in the law.

I have to believe the defense is going to fight hard to obtain a jury that is as open-minded as possible, unlike the prosecution in the OJ case.

The neighborhood association seems to be pushing this forward.

I don't recall hearing anything about that maggief. But I did stay at a Holiday Inn last night and found the following:
The Cab Driver who vindicated one of the Lacrosse players also said that he heard screaming and that someone said "oh she is just a screamer".
Screamer, meaning screaming while having sex obviously.

HONOWITZ: I'm really not aware of the law in North Carolina with regard to the grand jury but it's going to be very interesting to see what happens in this case with regard to whether or not he -- Trent mentioned before he doesn't know if charges are going to come down.
But I'll tell you something, Larry. There's other issues that people are forgetting about. There is a neighbor who heard screaming next door. There is, of course, the phone call that was made a couple minutes before, so these are all things that the prosecutor is going to do now in making a decision as to whether or not to go forward.
Regardless of whether they did it or not, she/he just wants a guilty verdict and a guilty verdict now.
I think there have been several posts where there has been shown quetionable connections between Durham judges, LE, and the DA's office. One big happy family. These folks scare me.
