Lacrosse players face old charges (Nifong retaliates against Duke Lax)

DURHAM - District Attorney Mike Nifong plans to reinstate misdemeanor charges against a half-dozen Duke lacrosse players, saying a March 13 party where a woman reported a rape broke the deals that the players made with prosecutors.

Nifong's decision could affect players who, before the party, had entered agreements in which prosecutors would dismiss the cases if the players performed community service and stayed out of trouble for six months or a year. Among the first to have his charges reinstated was David Evans, one of the team captains who lived at 610 N. Buchanan Blvd., the site of the party in which lacrosse players hired two women from escort services to dance. One of the women told police that she was raped by three men in a bathroom.

Two players, Collin Finnerty, 19, and Reade William Seligmann, 20, were charged last week with first-degree rape, first-degree sex offense and first-degree kidnapping. Their attorneys say the men are innocent.

On Monday, an attorney for Seligmann filed a motion seeking information that would help attack the credibility of the woman, the only person, according to the defense filing, who says a rape occurred. The motion seeks information about the woman, including criminal charges, mental and emotional problems the woman has suffered as well as social services, probation, child protective services and victim's advocacy records.

Today, Finnerty is due in a Washington court where prosecutors in an assault charge are considering whether to revoke a deferred prosecution agreement similar to those affecting other players in Durham.

According to court records, 16 players were charged in the past three years with misdemeanor charges in Durham including noise violations, public urination and alcohol violations. The deals placed the men on probation for either six months or a year.

These guys did what most rich, poor, and middle class guys and gals do in college.....if they're sociable. They study hard and party. That's all a part of growing up. Sure, they might do some "stupid" things. And someday, when they're a little older, they recognize that.

Unfortunately, these guys invited the wrong girls to their party.

And the only bores are people who criticize and accuse when they don't know what they're talking about!

UNIDENTIFIED MALE: I think, ultimately, kids have the responsibility and accountability. Student athletes have to be responsible and accountable for their behavior.

UNIDENTIFIED MALE: This is not and has not been charged as a bias- related allegation. I want to make that clear.

UNIDENTIFIED MALE: The fact is, only two of them now are the ones that are charged, and all 46 have been sort of colored, as if all of them had, in one way or another, been engaged in this kind of activity, whether or not some of them might have been at the place or not. I`m just troubled by that.

In a normal sane world, that would be a correct statement.
But here we have everything: Race, Class envy, 'furr'n Yankees', young men who are headed for bigger and better things while NC loses jobs in manufacturing ...
Luther's inkwell might have been speaking for a whole lot of people when he said "I want this DA to convict these guys of something, anything" (or words to that effect).

You're saying most DA's would take over an investigation from the police, hold some 70 public interviews on the case, and fix the ID process so that only a lax player would be picked? It's apparent that you haven't done your homework.

Absolutely, whatever her motive for doing so, she felt the need to take control of the situation and crying rape was the only card she had to play.

I am proud of my children when I have reason to be. I am not proud of them when they make very bad mistakes.

I guess that's the difference between us. I'm proud of my children every second of every day. Do I think they never make mistakes? Of course not! They're as human as I am. My challenge is to help them recognize mistakes and as my children become adults, they help me as well. I am blessed.

And in addition three defense lawyers tried to show Nifong exculpatory evidence (like the photos) pre-indictments, and according to the Newsweek article Nifong snapped, "I know more about this case than you ever will. __________________________________________________

So Nifong was confessing that he was from the start planning to withhold evidence from the defense team? That is prosecutorial misconduct and could leave him liable for civil actions by anyone harmed by his illegal action.

Nancy doesn't give up easily does she? BTW Megan Kendall repeating the AV's father's claim his daughter won't proceed. But I'm not quite sure the father remembers his story from one moment to the next.

LOL...get used to it...my now 24yo still does it...if you ask a follow-up question on the same subject he accuses me of *freaking out*........but when he does want to talk, I'm the one he comes to...

Wouldn't that be "boors"? And I do know that guys were arrested and charged with rape and kidnapping because they were accused by a stripper that they hired.

Well, I purposely watched her last night, and she compared this case to OJ Simpson's, Robert Blake's, and all sex offenders who killed their victims, both adults and children. And then she had Wendy Murphy there agreeing with her!

They are a disgrace! Geraldo is no better.

While she was talking, I was thinking of this post by Howlin, and I had to laugh.

I'm prolly a tad older than most FReepers and I've certainly seen it.
It would behoove every Duke grad and resident of the state of NC to make sure there are ample funds for investigation by the defense. These guys will have to prove their innocence. I'd be shaking in my bunny slippers if I were charged in this case. Even if they beat the state charges, they could face federal beefs.
