Duke rape accuser's records demanded

DURHAM, N.C. - The attorney for one of two Duke lacrosse players charged with raping a stripper demanded on Monday that prosecutors turn over the accuser’s medical, legal and education records for use in attacking her credibility.

Kirk Osborn, who represents player Reade Seligmann, said the material will provide “rich sources of information for impeaching the complaining witnesses.”

Osborn also asked a judge to hold a pretrial hearing to “determine if the complaining witness is even credible enough to provide reliable testimony.”

It was difficult to understand the cab driver but it boiled down to him probably being less of a credible witness than what he was. Some discrepancy between the 1:01 a.m. call to pick up the second group of four at Buchanan. Now he says it was actually 12:39 a.m. that call was made while Reade was in the cab. And something about him maybe being offered money by Reade's father? Hopefully the transcripts will be up tomorrow to sort out what he said.

Consensus was that witnesses for both the defense and prosecution need to stop giving intereviews because they lock themselves into prior statements which can be refuted by the other side.

8 cell phone calls from Reade Seligmann's cell phone during the time of the alleged rape. Also the cab drivers timeline off somewhat, but does not affect Reade I do not believe.

On Greta an attorney said that the information the defense attorneys are asking for scares most alleged victims. They are asking for everything concerning the av. He said that this is when a DA needs to support and encourage a victim to go forward.

I have a feeling that the av was told of this motion immediately by Nifong and what the father said about her maybe not wanting to testify may be true.

Attorney on Greta alluded to the Kobe av and said this was essentially the same thing that happened in that case. Defense made a similiar motion and the av didn't want to go forward with the case.

Also Monday, Osborn told the court in a separate motion he planned to present an alibi defense, based on the testimony of witnesses who are "known to, or should have been known by, the district attorney." The defense has suggested a timeline that argues if the dancers were performing around midnight, Seligmann left the party before having enough time to participate in the 30-minute assault described by the accuser.
