I had somebody try to tell me that the "lineup" as described is legit because she accused three people but there were ~46 in the team photos, therefore as a matter of definition she was in fact shown 43 pictures of people who were not suspects, so what's the problem?
I wonder if this will be Nifong's argument.

Well, the victim is supposed to be shown pictures of people who are NOT suspects mixed in with the pictures the students - all of whom were potential suspects. That way she cannot pick three at random and claim "They did it" and have those three face legal sanction. If there were a bunch of pictures of cops, for example, mixed in - she would have a 50/50 chance of picking a cop instead of a student on each pic. If she did, you'd know she was lying.
